Real Estate Woes

I won't go into details on a public forum, but a very nice real estate agent has suddenly turned nasty when questioned about areas that may fail the contract of offer and acceptance, and is being very evasive.

What sort of people can I talk to in WA about this sort of thing?

The govt bodies are not that much help on the phone so far.

If the agent is not the Principal of the business, try contacting the Principal and discussing your concerns with them.

The Real Estate Institute of WA (REIWA) What does REIWA do? - reiwa.com.au is an ok place for at least some additional knowledge about your rights when buying or selling.

all common advise about "Contracts" is usually answered with .... get your solicitor to check the "contract details" ... before signing anything

Are you the buyer or the seller??

Hi Mike, I am the buyer, but as a first home buyer I thought I did a lot of research, but you can't think of everything with out a bit of experience behind you.

As a first home buyer .... I take it your being "quite cautious" about these contracts .....

Are you trying to put "an offer on a property" .... or are you trying to "terminate a contract"??

Not wishing to terminate a contract as I am quite keen on the house,

But I need to find someone knowledgable who can explain why a major fault,
but not structural will not be fixed pror to sale

My reading of the anexure b seems to identify this, but the estate agent won't budge and is stalling me for time.

Can you get a couple of counsellors from Odin's Warriors or Hell's Angels to make her see and fix the problem?

Hi J,

Have you had a pest and building inspection done yet?
Is it a result of this? It sounds like a building issue.
If the contract isn't unconditional yet, which I assume it's not, you are within your rights to:
a) pull out if it is a major problem
b) re-negotiate the contract and price down, allowing for the price to fix/repair the problem.

If the agent is hassling you and not being co-operative, they're shooting themselves in the foot.
If they want the sale, they will come to the party. If it's an obvious problem, they will have this issue with every buyer with half a clue.

If you don't have a conveyancer/solicitor - get one.

I thought it depends on how the contract was written. i.e. some contracts are written such that you can only pull out if the house has "structural" defects.

Thanks for all the advice and PMs so far, I have been given a great deal of advice and information so far.

I will have to put my situation down to the inexperience of a first home buyer, and the possibility of the Settlement agent and Building Inspector possibly having a bit more of a close relationship with the Real estate agent than I am comfortable with.
