Exhaust stack, advice wanted.

Am taking the OKA to the RTA for rego this afternoon. Currently it has an exhaust stack.
The previous owner, ex NSW reg., got a letter in the mail from the EPA who told him to get a stack instead of the normal exhaust that came with the vehicle. He duly ignored it and the EPA had his vehicle de-registered! Cost him $1000 to put the chimney on which increases the cabin noise level heaps, which is why I want to put it back underneath where it originally was. I would have thought that if the vehicle was ADR compliant with the underneath exhaust when it was made that it would still be legal now ?
I'm not sure if this is a quirky NSW EPA thing or what.

Exhaust comes from engine/turbo through muffler then does 180 degree about turn, then a 90 degree bend into the vertical pipe. Originally it came out just behind the mudgaurd pointing down.
Anyone see any reason why I can't put it back where it originally was ?

I've never heard of anyone having to do that,not round here,we seen some hot rod trucks with it up the back but have seen them under aswell.
& most OKA'S have them under from the factory so you would think it wouldn't be a problem..

ADRs permit you to have it exiting from the rear or right hand side of the vehicle providing it points downwards and is at least X(30cms from memory) rearwards of an opening window.

He most likely had a complaint from some "Eco sound back to the trees" hippie about exhaust smoke or something stupid like that.
If it's ADR compliant having it underneath, the EPA have no jurisdiction to have it changed to car rear setup. They don't set the design rules.
Nationally there is a "dob in a smoker" kind of thing and while this is good for some situations, it opens up all the do gooders to complain and report even a puff of smoke without any actual investigation and issue fines on someones say so. In reality, just another money raising venture to help keep the justification behind a bunch of overpaid Government jobs.
But, I guess some peoples lives are so sad they just don't feel contented till they upset someone elses....

The regulation in NSW requires a vehicle over a certain GVW to have a exhaust stack 3 metres from the ground.
Noise can be reduced by isolating the stack from the cab and locating it to the LHS.........

So if it's based solely on GVM there's a lot of illegal Isuzu trucks out there, the new ones with the "afterburner" DPF have an exhaust that exits about 1200mm above the ground on the drivers side.

I've bitten the bullet and put the exhaust back where it's supposed to be. The OKA has an old technology diesel, no electronic crap on it at all. In fact the only electrical device on the engine is the fuel cut off solenoid (and I can unscrew that in a pinch if I have to). It's a 4 litre turbo Perkins that has done only 158,000 Km so smoking is not an issue. Thanks all for your input.
