I am having trouble with a particular make and model of mobile phone, I am on my second one which has now gone back for warranty repair. Searching mobile forums there seems to be a few common faults with this phone and people keep keep having them repaired or replaced only to have problems crop up again.
Is there a point when you can say: "This phone is unacceptable, I would like another model", and legally you have to be given the choice because the product is not up to standard?

If it was not of "merchantable quality" it would not be allowed to be sold. A case of buyer beware. Check the internet before you buy to see what people think. If you have handset insurance with your phone plan then just keep on sending them back for repair, and get a replacement loan unit. They will soon get sick of repairing it and give you a replacement.:)

Just out of curiosity , is the make of the Phone a HTC ?? don't mean to bag this make of phone but my HTC Touch Dual crapped itself after 3 months:(

If your'e with telstra, then their multiple equipment failure policy insists on three equipment failures before they will cancel the contract. In the meantime, if your'e not happy with the providers response to your dud gear, ring up the telecomunications ombudsman, and get a reciept number for your complaint then wave that at the provider. It might move things along. Don

I ended up posting my situation to a technology/communications website, my provider posted a reply within half an hour and a new model of phone is on the way!
