How long do demerit points last before they are removed? Is it one year or longer. Jim :(:(:(:(. Not mine but my wife's.:o:o

Not sure in NSW but in SA its 3 years , from date of offence.

I believe its 3 years in NSW as well...

as I to say to P plate people,
get one more of these (ticket) and you get a pushbike... (not from us but you'll need one! )

On checking my points collected 5 May 2009 I noticed they are still there today. I've sent an email to RMS (previously RTA) and received this reply:

" Please note - The demerit point laws do not place a limitation on the age of offences that can be counted towards demerit point suspension but the Roads and Maritime Services will not count offences that are more than 40 months old. Doing so ensures that only recently committed offences are included. The Demerit Points Enquiry Screen will show all offences that are not more than 40 months because they have the potential to count towards a demerit point suspension. When the offence you have referred to is more than 40 months old, it will no longer show on the enquiry screen."

So it looks like 40 months until points no longer count in NSW.

Is this another case of the RMS making up it's own rules? :mad:

NSW Legislation "Road Transport (Driver Licensing) Act 1998" http://www.legislation.nsw.gov.au/fullhtml/inforce/act+99+1998+pt.2-div.2+0+N?

Specifies: "Subdivision 2 Consequences for unrestricted licence holders who incur demerit points

16 Suspension of licence

(1) (Repealed)
(2) Licence suspension for demerit points
The Authority must give a notice of licence suspension to the holder of an unrestricted driver licence who incurs 13 or more demerit points (or in the case of a professional driver 14 or more demerit points) within the 3 year period ending on the day on which the person last committed an offence for which demerit points have been recorded against the person."

Now unless something has changed in the space time continuum 3 years = 36 months not 40?

In fairness, that does not say anything about the points being removed. Just that anything older than 3 years doesn't count towards a suspension.

I went to see them just now, but I get the same answer that they are removed after 40 months.

Not sure I'm convinced when the RMS has a habit of making up it's own rules and only backs down when the Minister intervenes or they lose a case in the Courts. We just have to go back to VSI 50.

However it may be a case of an administrative function to account for any appeal time.

Just to add to this... While you may get your "demerit balance" back to zero after three years, when you apply for a CTP green slip and they ask you how many demerit points you have /at fault accidents etc, they actually go back and check 3 1/2 years!!!
Insurance companies:mad:
