D3 brake issue

After a trip down the east coast I have gotten sick of reseting the flashing park brake light and the occasional shudder from the rear brakes and taken in to Landrover Service for diagnosis.
Apparently the last owner drove though a lot of dust..
Dust up the brake cable lines has fouled the cable and caused the park brake to not release correctly, causing both a park brake indication issue and the occasional shudder from the rear, when the rear brake does not release properly.
According to the dealer this will require replacement park brake pads, rear driverside disc replaced (as it has discoloured and cracked) and new pads on the brake disc. All for around 1300 bucks.
Thats the good news, as the Dealer that sold the vehicle to us has pulled out 'Statutory Warranty' and claims the brake issue is not covered under warranty, gee thanks a lot for that aftersales feeling of contentment...

Any body seen this issue or part of before? I havent climbed underneath to see if there are actually any brake cables
Has any one got a clear knowledge of the afore mentioned Statutory Warranty?
BTW how can dust become that big a problem?

I think you will find they should fix under stat warranty. Was it a LR dealer?

The dealer that we purchased from was Mercedes but have had LR diagnose the issue on advice from Sales at Mercedes.
I have yet to read the statutory warranty document and am searching online right now.

It does not matter what their doc says it is what you are entitled to under consumer law that matters in the end. You need t give them the oportunity to fix (in writing) before taking it further. Stick to your gunsand thay wil fix it.

I don't believe I have seen any std warranty that includes brakes, fluids, tyres, or shock absorbers. They are all generally regarded as consumable items. I would see what they will agree to. I think you are doing well if they agree to share the costs.

We are not talking about just normal worn brake pads here. Vehicle was supplied with faulty park brakes in the first place.

I think you will find brakes are covered, unless you think that a failed maste cyclinder or calipers would not be covered.

SO...
Having accepted that the vehicle is now out of warranty (Statutory Used Vehicle-5000k/3mth) after travelling approximately 7500k, we bite the brakepad and pay 1300bucks for LR to fix the problem.
Not the end of the story, of course!
Having decided to take a trip to the Sunny Coast from Bris, just 40odd K's up the Bruce hwy the dreaded Brake Shake kicks in again!! :censored:!!! and in busy traffic at 110Km/h...
After negotiating the traffic to the side of the motorway I got out to inspect the issue and found smoke coming from the passenger side rear brake(not the drivers this time), the disc a slightly blue colour (radiating heat) and found that the wheel hub is to hot to touch.
An irritated call to the now well worn dealers ear regarding the sale of a vehicle with pre-existing and dangerous faults whether diagnosed before or after warranty period; just to let them know there will be more discussion.
Next stop LR service to find out why they have not resolved the issue !!!

This is normally an adjustment issue when fitting new handbrake shoes.

At least it's 'warranty' now (not really warranty for the repairer as it's called a 'comeback' to him).
