what is more likely to be cause the transfer case leak the lay shaft or the what I think looks like the diff lock arm, pics attached, its just an annoying leak as it goes on the exhaust giving a oil burn smell.

also when cold just off idle at low throttle the engine runs a bit rough like it has a miss this is gone after prob a min or 2 of running and rearly happens if you have time to warm it up for 2/3mins before going, glow plugs test ok on nanocom, also once above about 1800rpm miss/rough running goes

Usually the intermediate shaft o-ring , but the shaft can also flog the hole in the case out of round. Have also seen the big end of the shaft wear badly.
Hi low selector also looks like it is leaking.
Cant do either in car, you must remove T/C
Also check hand brake drum for a big crack have seen 2 in the last week , very strange I thought.

As for the miss look at the injector harness ( stupidly located inside the rocker box in hot oil )
and check the red plug on the ECU for signs of oil , unplug it and look in ( this can be done quickly before you remove the rocker cover _
