Just had a phone call from my son , it appears the local police have pulled him over & booked him for being "unrestrained" in my 2a ex army lwb. Apparently there is a rule somewhere to say a P plater is not permitted to drive a vehicle without seat belts . Is anyone else aware of this?

Series 2 shows as an approved vehicle in Victoria. As long as its roadworthy there shouldn't been any issues i would have thought.

NSW the cops did a 5 post bullbar blitz the other week & fined a few ute owners without there being any official ruling on what makes a bullbar illegal & now they say that somewhere in a police manual is a law that says P platers cannot drive a vehicle not fitted with seat belts!

I would be going into your local Transport Dept and checking and if possible getting something in writing.

If the vehicle is legally registered,and is of pre seatbelt age, and there is nothing in the regulations forbidding a "P" plate driver from driving it I would suggest the copper is whistling in the wind.

I know that a commercial type vehicle (a Series Landrover is classified as such in Qld) it did not require seatbelts until first registered after 1/1/72.

I'am also aware that the brushbar on an ex-military Series Landrover is set 1/16th-1/8th of an inch behind the front face of the bumper, and does not reach/cover the outer mudguard panels.

Thanks uncle , I don't have the full details as yet (if they were being clowns) but am unable to find this supposed law anywhere.

Sorry you are wrong on that one too - it has been discussed in another thread. ADRs for bullbars fitted to post 2003 vehicles are clear and are applicable nationwide.

This is for imported cars but may help?
No mention of P-Platers but it does mention not needing belts in pre 65 or 71 vehicles depending upon type.

Personally it sounds like a cop who doesn't know the rules on a power trip. My wife had one a few months ago verbal her for getting out of the car to let the kids out in the drop off zone, the idiot didn't know you can legally stop engine, get out open the door , put up their umbrella and stay within a few metres of the car.

Interesting as I was certain that rule applied here to L, P1 and P2 drivers,

but looking for a reference seems it may have been slipped out last legislation update (or missed out in error last time they updated the TRANSPORT SA drivers info site.)

It had been in force here for some time, it wasnt usually enforced (maybe by traffic) by general patrols unless there was some reason it came to our attention..
(as an example refer attitude, other offence/s or suspicion of possible involvement other offence/s).

Thanks isuzurover , He's only a P1 & I taught him to drive in the old 2a which is why I believe he passed the test 1st go when stuck in a modern vehicle (no double shuffling & boosted brakes). I did check the Geared P1 & noticed the line you pointed out in the P2 edition is not listed.

That page is just a summary of the legislation. If you look up the legislation it says it applies to L and P1 as well. It also notes this is an additional law added in NSW.
