Can I set the 5S up by using the backup I have of the 4.....or will there be issues??

You can use the backup without any issues.

Thats the beauty the iCloud back up. When I went from 4 to 5 and then to 5S, each phone became a carbon copy of the previous. Apps in same place, all emails messages notes everything as before.
So I would think that 4 to 5S should be ok. If 4 is operating on old IOS and 5S is on newer IOS8 their might be some issue
