A question for the experienced repairers of TD5 engines.

I feel ripped off over the following.

An exhaust manifold replaced because it had been 'de-webbed' and had had larger studs fitted at ports 1 and 5.

A radiator (8 months old) because the engine had overheated, they were doing a head gasket. The nipple might break off.

An injector loom, because we always replace them, the wires break when we put it on the bench.

I am taking various other problems to the RAA in SA because I feel there has been a right royal rip off in more areas.

Was there a quote for the repair?
If these parts weren't included in the quote then they should have asked you before just replacing them.

Manifold dewebbing and larger studs is what we do to stop them warping so it should have been left. Radiator hadn't broken yet so no. And the injector loom is complete crap, Wtf are they doing to it on the bench!

If you didn't authorize it they shouldn't have done it , if it was mine I'd be making them refit the manifold at no cost it is common though to clean radiator out when doing head gaskets otherwise they will not guarantee the work

A radiator (8 months old) because the engine had overheated, they were doing a head gasket. The nipple might break off. Whilst older radiators may suffer, this ones just blatant rubbish - demand the old unit back or a credit

An injector loom, because we always replace them, the wires break when we put it on the bench. Replacing this loom isn't a bad idea whilst its apart. Its cheap insurance.

I am taking various other problems to the RAA in SA because I feel there has been a right royal rip off in more areas.

If you didn't authorize it they shouldn't have done it , if it was mine I'd be making them refit the manifold at no cost it is common though to clean radiator out when doing head gaskets otherwise they will not guarantee the work

I agreed to a clean out but $409.09 (ex GST) for a new radiator when the one in it was only months old?

Bah Humbug.

Just done my sums on what I claim to be wrong with the work done altogether and it comes to $2785.01, boy I could do with that back in my pocket! :o

I guess I won't be going back down south for any more work to be done. :mad:

If he sold the radiator to you for $409, he would have bought it for a fair bit below that. I'm betting it's going to be a Chinese one.

Three times I went back what a sucker for punishment?
Like I said, trust me I won't be back unless it's to collect my money back, but I'd rather just a bank transfer.

Just one comment on the price charged for the radiator..... Mine is a genuine one but it was a little over $1,000 from memory. I'd be a little worried about a cheapie in that department...... an engine rebuild will sure as hell be more than the $600 difference. Ask me.... I KNOW!

Wow... $1000 for a radiator? I've never heard of a radiator for a Landrover costing that much. [emoji33]
You could get the best custom made one for cheaper.

ADRAD, the previous radiator supplier, have confirmed in writing, there was "NO REASON TO REPLACE THE RADIATOR".

I am still waiting on written confirmation from TCT to argue poor fitting was the problem with the torque converter, then I expect "THEM" to pay for refitting the TC.

A letter of support is coming re the head and/or gasket not showing any obvious fault, Mt Barker Engine Repairs guy said, "Yes, it's been leaking there, there and there at least".

Consumer affairs are aware of the situation and when I have my evidence if the company doesn't come to the party they will step in.

A new radiator, not a Chinese copy, RRP $350, sold to me $320. Description of radiator - RADIATOR,TD5, DISCO, NISSEN brand. Made in Europe, purchased from MR Auto. Bob

Well, after all this time and now having gone to court I have been awarded what I was asking for in the first place, justice.;)

Thanks to those who supported me, those with advice along with those with good wishes.:D

Just goes to prove, if you think you have been ripped off, collect your evidence and push it all the way.:cool:

The Office of Consumer and Business Affairs here in SA was no use, they just accepted the company's word and dismissed me.:mad:

Now I get to have my special TC from Torque Converter Technologies fitted properly at their cost, beauty.:)

Despite a Magistrates ruling, a Registrars ruling to pay by 12th Dec or lodge an appeal against the decision nothing happened.:(

After the time allowed 'THEY' got a lawyer involved to have the decision overturned.:censored:

Now waiting to see what happens??????????????????????????:angel:

I'm keeping my chin up though, too hard for others to hit it if it's down!:D

Despite doing everything correctly and THEM doing everything wrong today a lawyer triumphed (as they frequently do) over justice.:censored:

At today's hearing in the Magistrates Court, the original decision was 'set aside', that means I have to start from the beginning all over again!!!!!!!!!!!:censored:

Now, if you want to get a feel for how I'm reacting just look at the little pictures at the end of each paragraph.:censored::censored:

Spoke to someone who knows a bit about law etc, he suggested THEY 'may' have been to court enough times to know how to play the law.:wasntme:

Certainly seems like that to me.:censored:

Reason for the decision being 'set aside', they simply forgot to (get this) 'diarise' the date. Didn't matter that I had actually reminded them via email, and that it was three separate dates/actions they had failed to comply with.:censored:

I'd better shut up or I'll be :censored:

I think Disco Mick hit the nail on the head.

I was on THEIR site today and there was a 'review' section. I gave it a one star and said what I thought then erased the lot so as not to give them a leg up.

Unfortunately the courts are facilitators of these ridiculous games...and are rarely able to call abuse of process even when it is clear that it is there......
all the best with it.
But it is a warning to us that unless you are willing push it for years then it might not be worth the psychological cost.

Unfortunately, failing to record dates is exactly the sort of nit-picking which clever lawyers use in appeals to undermine the validity of findings.

Luckily lawyers are not allowed in small claims court, in SA anyway. :D

Should have seen the lawyer bolt after the hearing the other day, she was put right on the spot by finding out what I knew and had done that she had not been informed of by her client! :cool:

Oh, and we learned not to give up nearly fifty years ago when the Government etc refused to accept 'Agent Orange' as a carcinogen, we :wasntme: were right then and it has rubbed off onto anything confronting.

Well, re my last post, THEY won a review, we have to go to court all over again. :mad:

BUT, I had a moral victory, the Magistrate ordering that THEY pay me $250.00 for stuffing me around, small victory I know but none the less I enjoy having it in my bank and the note saying "court ordered".:D:D:D:D

It's quite sad to hear the SA legal systems has done its magic again. I don't like to see people getting ripped off for no other reason than either lack of knowledge, time or equipment. I don't think anyone minds a reasonable living to be made, but that place goes well beyond reasonable with second hand parts often costing more than new imported parts and that includes the cost of shipping! I hope some good comes of this. I guess if nothing else people may start to realise that that place has been less than reasonable for at least the last five years. I believe we have a couple of good land rover places in Adelaide now if you need a mechanic, I personally haven't used them but others have. That place however needs to be given a very wide birth. Just because its big and been around for LXX years don't mean its any good now, which is a real shame.
