View Full Version : I've upset my neighbour - oops...

Got a letter from the Council today - A schedule 2 notice to comply.

I know it was my next door neighbour, as he's a grumpy bugger and the only one on the street that no one gets along with - won't come to street parties, have a beer on a Saturday arvo, etc.

Admittedly the front yard looks like a bit of a tip at the moment as I've been peddling hard to get the Caravan ready for Corowa and Melrose, so I don't have an issue with the clean up part as I was going to do that when we came back anyway.

One of the items though said to remove all unregistered vehicles from the property - jokes on him as all the vehicles and trailers I have are all registered or on Club Permits, so he can suck it on that one.

Will call the Council tomorrow to clarify that bit as I'm not sure what they want me to do there.

One things for sure though, my Neighbour will be having 3 cars parked out the front of his place from now on so my front yard looks good and uncluttered...:D

He'll have a cow about that - he already cracks it when I park my work car out the front of his place, but hey, if they are legally parked, not sure what he can do.

Anyone know if there's a generic rule about how many registered cars can be kept on a residential premises?

I also need to find out how high I can go with fence screens so I can keep the nosey **** from looking over the fence from his back verandah.

You'll have to sell up.
I know a really nice place you can buy, with an understanding neighbour, and no need to park vehicles in the street.

We have to park our son's car on the front lawn as Kristopher go hit when he was park out the front of our home and they took the back driver door out. And last week Brendon had his car park outside our home after he had a lesson with Mario and someone back into him hitting his right hand blinker and broke it and drove away.
One one in Tecoma know how to do a 3 point turn in our street.
So now both car are on the lawn.
Drive way has the boat and Mario's disco2 and my car and the lawn also has the trailer and the camper trailer and yes they are all registered so let the council laugh about that, They can not do anything about it.
Mario is getting sick of fixing the boys car from people who can not drive and take off.

What is the ofence they have accused you of?
Hume City Council - Local Laws (http://www.hume.vic.gov.au/About_Us/Your_Council/Local_Laws_Legislation_Parking/Local_Laws)

Still looking.

The way I see it, you can't have unregistered vehicles on council land. See section 3.5.
http://www.hume.vic.gov.au/files/assets/hume_website/i_want_to_images/final_general_local_law_no1_-_2013.pdf

They could get you on 3.1.2 so puting the registered vehicles in front of the neighbours place and backing the van up the side with the 101 would be a good move.

Since when has it been illegal to park an unregistered vehicle on your property.

I'd be telling council (and the neighbour) to shove it where the sun don't shine - I'm sure they could find a place like that - even in Sunbury. :p:p

I'm glad you live there too Bob. :D. Funny thing is that I know everyone in the street, also everyone at the end of the street, and 4 houses behind me on an adjacent street. The only person that won't talk to each other around here is the douche next door. I think most streets have them - you know the one that doesn't get on with everybody and just causes issues for the sake of it.

Also funny is that all my neighbours except him have offered to come over and help clean up on Friday arvo - they're all on Facebook and are friends on there so have seen the message SWMBO made about it. My bet is he will cop more grief from my other neighbours than myself. That's happened in the past too.

I've been accused on breaching regulation 3.1 of Local law no 1. "Allowing land at .... To be unsightly or detrimental to the health and general amenity of the Neighbourhood"

That's pretty wide ranging and open to interpretation. I'm not questioning the mess - it needs cleaning up, but if someone starts picking on my cars, they will incur my full wrath. Can't see that they can though as making an assessment of what is a nice vehicle or an ugly one is purely subjective. There are a lot of Fords in the street - they are far uglier than anything else around, maybe they should all be issues a notice too...:D

Oh, and they're not just talking about the front yard either - they say the entire property. Some of the details can only be known to my neighbour who is the only one that can see into my backyard.

Difficult to see why you would quote me. We are not even in the same state. We have the Brighton wetlands behind us, and have a good relationship with council. Any issues, of which there are few, are normally dealt with face to face. They deal with random complaints like the one in this thread by coming out to have a look. Of course, they do not reveal who complained. I built a 7x4 trailer at home, we had a neighbour who complained about the noise, after talking to council, I left a flyer in the letterboxes of my immediate neighbours, offering to talk about a compromise. Turns out there was a shift worker up the road, who could not sleep with the noise. Fair enough. I only worked on the trailer when he was on day shift. And invited he & his wife to the christening of the trailer bbq. All good, the Qld way. Bob

I reckon the neighbour's house is "unsightly or detrimental to the health and general amenity of the Neighbourhood". Perhaps he should be made to knock it down.

100% agree this is the way it should be done. Talked through and a mutually agreeable solution found. Once I've cleaned up, I'll go and have a friendly chat to him to see if I can make him feel comfortable enough in the future to just knock on my door and have a chat. I get on with most people, I just seem to have missed the mark so far with this guy.

Thinking of popping this in everyone's letter box in the street. It may make him feel like he can talk to me. (Details deleted here though)

Hello there, I just want to introduce myself - my name is ...... and I live at number ............... I've posted this to everyone in the street as recently the Council received a complaint about our place, and I just wanted to clear the air with everyone.

I understand entirely why this was done and wanted to apologise for the mess that has been out the front for some time while I was restoring my old Caravan. Most of you will have seen all of this in your travels, and many of you who I know personally and just to say 'g'day' to as you walk past may have wondered what's going on. I spend a lot of my free time working on my classic car collection, particularly my 101 forward control you have all no doubt seen in its Military outfit that lives in the driveway.

Although I have a large collection of cars, bikes and trailers, they are all registered or on club permits so I hope that this collection of mine doesn't cause issue with anyone.

While I understand it can be quite confronting to talk to a neighbour about issues they may have, I do implore you to come and see me if anything I'm doing causing an issue to anyone - it is certainly not my intention, and once bought to my attention, I will in all cases work out a solution immediately as I have previously demonstrated to people here in the past. I always keep to the EPA regulations regarding noise, etc, but if you are a shift worker or similar, please let me know and I'll be happy to work around your sleeping pattens.

Please feel free to call in and say hi (there's usually a cold beer in the fridge) call me on my mobile - .... ... ... or email me at .............. if you want to or need to. I'm always up for a yack, and will be attentive to your concerns.

Again, apologies for my recent messiness - I'll try to be much more vigilant about this in the future, and please feel free to come and see me - I'm really quite approachable as many of you already know. We all live in this nice street together, so we should all get along which is always my intention.

Best regards - .....

I had an unregistered car parked outside the front of my last house. It still had plates on it & I kept it clean so it looked OK but someone complained to the council.

So I moved it.

And replaced it with a wreck & an old trailer sitting on my car trailer:

Just had a quick look, council can do stuff about unregistered cars making it unsightly, but IMHO if they are registered they can't do jack. If that was the case they would prosecute every large family whose kids have cars. I know in the future we will have 7+ cars, a trailer, a boat etc, parked regularly with 5 kids.

Are you sure it is unkept and not unkempt?

Unkempt, unkept

Unkept and unkempt share the broad definition neglected or not properly maintained, but unkempt is usually reserved for describing a person's rough appearance. The word is derived from the older unkembed, meaning uncombed, and is most appropriate (etymologically considered) in reference to disordered hair.
Unkept, meanwhile, tends to describe neglected properties. Of course, it can also mean simply not kept (usually in reference to promises). Our Microsoft Word spell check catches unkept, but it's a perfectly good word.
This unkept?unkempt distinction is not a rule, however. Unkempt is often used to describe untrimmed lawns and hedges, for example. Unkept is only rarely used to describe people, but we did find a few instances in our searches.
And, in case anyone is wondering, kempt is indeed a word meaning tidily kept or neatly combed. We assumed the word was obsolete, but, in searching, we actually found a few examples of kempt used in current news publications. It's usually part of the phrasal adjectives (http://grammarist.com/grammar/phrasal-adjectives/) ill-kempt and well-kempt.

You need more to do Ron.

this thread has gone astray a bit, an englander lesson even.

in all honesty the council get hundreds of these each week and unofficially regard them as a pain in the back side. if the bylaws are followed then so what. your neighbour can complain all they want, nothing is going to happen. people who winge to the council are not going to damage a car etc etc and if there is any criminal activity just call the cops and give them copies of your council letters.'

at the very most complain about his dog barking at night but even that is childish, stand still in the storm and just cover your ass. i doubt he is going to change and nor are you so it is what it is. if you do any thing to him he is just going to get more bitter and twisted. you do not want to spend your nights thinking about what he is going to do or what you are going to do nor do you want him spending his nights thinking about what he can do or worrying about what you are going to do.

so what i am saying is be a man, show nothing and do nothing and that way you win.

Even though you have not and do not present as a threat to him your neighbour could take it into his head to have an Intervention Order made out against you. He doesn't have to prove anything in the first instance either - it will automatically be granted.

When it goes to court as it must for either confirmation or dismissal as frivolous and unsubstantiated you will still have a permanent record of having an IO issued against you. This can have far reaching effects on your future - think employment etc.

Keep your head down, don't respond and keep a diary of events. This may prove to be a very useful defensive tool later on if matters become ugly.

Good luck!

I've only seen or heard from anyone from the council once in the twenty years I have lived here. (and that was about a new street number) The only communications I have from them are rates notices.

John

John, that's because they can't find your place, the last two did a perish in the scrub, I should know :D Didn't realise you could have a street number on a fire trail :o

Your neighbour sounds a bit like my brother inlaw - who co-incidently lives in Sunbury, and would be one to complain about a neighbour to council, but I know it is not him as the only lady in his street is when I bring the Disco to visit.

this thread has gone astray a bit, an englander lesson even.

in all honesty the council get hundreds of these each week and unofficially regard them as a pain in the back side. if the bylaws are followed then so what. your neighbour can complain all they want, nothing is going to happen. people who winge to the council are not going to damage a car etc etc and if there is any criminal activity just call the cops and give them copies of your council letters.'

at the very most complain about his dog barking at night but even that is childish, stand still in the storm and just cover your ass. i doubt he is going to change and nor are you so it is what it is. if you do any thing to him he is just going to get more bitter and twisted. you do not want to spend your nights thinking about what he is going to do or what you are going to do nor do you want him spending his nights thinking about what he can do or worrying about what you are going to do.

so what i am saying is be a man, show nothing and do nothing and that way you win.

I actually agree with you, must be getting old. Childish crap, really. Bob

Now Gav

Seeing as the council has not yet had a look at your place and you are cleaning the place up, I can't see this going any further, especially concidering this has only been a tempory thing and is cleaned up every time.

Hi bacicat, as a general rule regarding fence height, side fences can be a maximum height of 1.8 mts upon application to council you can have a higher fence to what they consider to be a reasonable height, this incurs a fee
In regards to front fence 1.2 mts for front fence (maximum) but again it can also be up to 1.8 mts at council discursion and of course a fee, that's providing your front fence dose not obscure traffic vision e.g. on a corner

Funny you should say that, I called the council today and that's there biggest concern. She was very nice and said just get everything off the nature strip and clean up anything that can be blown about and that would be fine.

I asked about keeping vehicles on the property and she said I could keep as many as I liked as long as unregistered vehicles were on the property and registered vehicles were parked legally on the street and not on the nature strip.

Now Bobby. For someone who said this is all childish crap and this belongs in a sesame St forum, why does one keep coming back to this thread? [emoji16] I might be wrong but usually when there is only one neighbour who doesn't get along with all the other neighbour's, they are usually the one to cause a lot of the problems. And in my humble opinion he would be the first one I would be pointing the finger at. But that's just my opinion[emoji6]

Jack and John are standing behind a wall.
Mary is standing at the edge of the wall, she can see both sides.
The rest of the team are on the other side of the wall.
Jack stabs John.
The rest of the team don't know.
Someone tells the police.
Can only be one person, can't it Bob? ;)
Gavs point is the ONLY person who could have complained about aspects of his yard which are mentioned in the complaint is someone who could see over Gavs fence into the back of his yard.
I.e the neighbour...

You can drive it within 100 metres of your residence without filling in the logbook. At least, it can be parked in the street.

Great, Shane, a 101 or two will be heading your way soon. You do have a shed they can be housed in and worked on, don't you?

garaging I'm sadly short on... You'd need height to fit a 101 in. I'm not sure if one would fit under any door here  I accept donations of carports and garages though :p

I might be able to sort something out in the short term undercover if you stuck for storage (by re-arranging junk around the yard ... again :) ).

Thanks goodness you aren't in the USA. In some places, you can't even work on your car in the driveway.

This appeared on the Hillman Yahoo List which I'm also on:

My good neighbors, with the complete cooperation of the local constabulary, have determined that I am parting out (breaking) my bone-yard cars. They include the following:
Minx Series IIIB De-Luxe Remote Control Floor shift, Convertible
Minx Series IIIA De-Luxe Column shift, Estate Car
Minx Series IIIB De-Luxe Column shift, Estate Car
1600 ADL (Series III Hillman Singer Gazelle) Column shift, Saloon, R.H.D. - AB7196727 MWSO
These cars are JUNK.
But they have lots of good bits!

Larry is in Missouri.

Linden, in San Bernadino, replied (my emphasis):

Here in urban California, you can't have a car parked visibly on your property that doesn't run. I have heard of the code nazis asking to see what folks have in their garages, too. Fortunately, I have a commercial property with a business license, an auto repair license, and a used car dealer license, so up to this point they haven't been on me. We did clear out a lot of the non-runners last year, and most of the leftovers are now behind a fence that is screened from view. I don't ha e a lot of trouble with the license inspectors but they know I try to do the right thing. Attitude is all!

Right now I'm down to 3 Jags, a Morris Minor, my son-in-law's nonrunning Jetta, one grandson's nonrunning Cavalier, another grandson's Jetta with a lost key, am driving a third grandson's reject Tempo.

Linden

Larry responded:

They sit way up on a hill away from my house but quite visible from Their road. That's where they have me. They can see 'em.

Hmm, I'll have to ask my old man what the score is regarding this. Obviously must be OK where he lives as the "fleet" which decorates the driveway consists of:
P38 - running and in great condition, driven by my mother!
P38 number 2 - non runner, used to keep the other one healthy.
'92 RR classic - runner.
'94 RR classic lwb - non runner, being rebuilt.
Another RR classic of indeterminate age, non runner, donator of bits to the other two.
S2a - runner, daily driver.

My next door neighbor is a police inspector and there's another cop up the road, so its pretty quiet in our street. Funnily enough, our neighbor (who is a very nice bloke) is also a noisy bugger and is frequently heard on his police mobile loudly issuing instructions to junior officers or discussing things we probably shouldn't know about. Makes for amusing entertainment sometimes when I'm sitting in the carport reading a magazine.
