Have an issue with my gearbox, it seams to stick a bit in about 3rd or 4th mainly on a slight up hill
I can manually change it but shouldn't have to, Any suggestions on the problem.

Have you checked your fluid level?

The box has only been rebuilt about 6mts ago. By a reputable dealer here in Canberra, should be right with fluid level etc.

thats probably a better reason to check the fluid again mate.
bmw is a reputable brand, yet they still made a mistake by putting this gearbox in the l322.

Take it back and ask them to check it.
Even a "brand new" freshly built box will have crud and crap in it,, if they didn't put it on a dyno before install, it may well have some crap partially holding back a valve.

Flush, change the filter and refill.
