I was at the liqour barn with my 20yo. She happened to have wine in her hand as she picked it up for me and I had one.
I was refused service as she had no photo ID (as she was not buying anything).
So I said I would only buy the one I had and was still refused service and was told how did they know I was not buying it for her.:mad:
THIS IS THE LAW they said. :angry2::angry2:

When I was in Derby last year, I noticed a sign at the Woolworths liquor shop which stated that alcohol wouldn't be sold after 7pm to anyone who hadn't driven to the store.

that seems even stupider. "if you want to buy/consume alcohol, you must be driving a motor vehicle..."

I think they're hoping the purchasers will take their drinks and go away.
When I was in Florida, I was carded buying beer in the supermarket. I was 26 or 28 at the time, but probably the youngest customer in the entire supermarket.

I can understand your predicament, the fines are doubling in Victoria for serving to the underage and supplying liquor to an underage by a 3rd party...no ID, no service. The fine is approx $12K

In Mt Isa you can buy a 4ltr cask for $10.00 and "they" take it over the border and sell it for $100.00 so therefore you can not but wine before 12miday. I guess that discourages anyone cous it will be too late to get back home to drink yourself........MAYBE......

So what if you look obviously old like some of us ;), must they still ask for ID?
Push the point, after they have rung it up on the till, don't hand over any cash until they ask you for age verification! Then threaten to report them to the liquor licensing mob!:nazilock:

hmm.... I have experienced this so many times but being younger it is very much different I suppose.
Now, on to your situation. The N.S.W. law and commonwealth I'm pretty sure are that a child is allowed to be with the Parent when buying and this is fine. I guess it is up to the child or parent to prove they are family? It's safe to say this is a grey area.
Look at it like this. What if a 10 year old is with you and picks the alcohol off the shelf for you or helps you take it to the counter do you think you'd be refused service? of course not. Do they want ID for that child or everytime you go to the store you won't be able to buy alcohol 'cause you can't leave your kid in the car either.
It's silly, I agree. And at the end of the day if people are going to buy for minors then they will and they will know the law and they just won't make the "mistake" you made and I've made more then once.
Just in addition after reading a few comments here- this has been going on for years. This ain't Rudd at all. I can remember 5 years ago being with a friend and they wouldn't give him the grog even know he was over 18 they said his ID was fake. I went back in 10 minutes later and bought it and I was not 18, never asked for ID or questioned me at all.

It's all part of the "underage binge drinking" campaign.
Maybe Miss Ho Har looks underage and in the mind of the cashier he/she might of thought about the consequences if caught selling to an underage person via a third party....especially when Miss Ho Har had no ID

Then why would you bother going back there? I would be writing to the owners, probably Colesworths these days, and telling them that you and your extended family will never spend one cent in their establishment again, and you will be telling all your friends, acquaintances, colleagues, club members, lodge brothers, co-religionists etc. how you have been treated and asking them not to go there either.

I went into an independent grocers/bottlo the other week and there were two young girls serving. I walked up and they said they couldn't put the beers through the register as they were too young, one went out the back and got an older bloke(dad maybe).
He picked up the two long necks ran them through the bar code scanner and walked back out to the store room. The girl took my money and gave me my change...fooking stupid.

Guess who broke the law.....
The young girls were too young to sell the grog and too young to have a RSA ticket. The old man is at fault for allowing the girls to complete the transaction.
If he had of scanned the goods and taken the money to complete the sale then the girls could of put the long necks in a bag for you.

I mrs Ho Har case the sale shouold have been ok but from a strictly legal point yes they should ask and require ID.
I spent years working a bottle shop in a rough area. A parent can buy alcahol so judgement on age should have been made. Sounds like they didn't this time.
In trouble areas you have to be harsher as word spreads quick if you are a push over.
It is not easy working these places when you get the dregs of society comming in repeatedly trying to steal while extreemly drunk. I used to often see a group talking then 2 would peel of and come in while the others tried to hide.
My response would be the same each week. Have you 4 mates out there behind that bush come in and show me some ID and I will serve you.
Oldest person I ever asked or ID turned out to be 29! She loved it but I felt quite stupid.
Nicest youngster I ever had was a girl who had just turned 18. She came in asked about what she wanted for her 18 birthday party and then had her dad pick it up the next day even so that there would be no problems with 17 year olds at the party.

Coming from the other side of the counter, and keeping in mind that I wasn't there but have seen this happen firsthand hundreds of times.
I ran a Bottleshop for 2 years. I still work for the same shop as a second job to my apprenticeship ($20 a hour! :D ) I have refused TONS of people and I consider myself very good at it, telling people they cant have something is not easy. I have heard every excuse and seen every situation. Parents get so angry when the 17yo daughter walks down and picks some raspberry vodka cruisers out of the fridge while they are looking at the reds. They then both wander up to the counter and don't understand when I tell them I'm refusing them service. It was obviously the 35yo dads drinks he was just to lazy to get them
The person who served you did nothing wrong but maybe should have explained themselves better. As far as I'm concerned there is no grey area, If I have ANY suspicion AT ALL that alcohol is being provided to a minor I will refuse service. It is simply not worth the risk to sell it as there are very large fines for you / me / my boss. Around $3000, $6000 and $18000 respectively. These fines do get given out as well, they are not just a threat. There is no common reason a person over 18 shouldn't have ID on them, if your in a shop you have your wallet... and thats where you would keep your license or 18+ card. Complaining will also get you nowhere unless the person was actually rude to you. Thier employer should back them up 100%.
Also these rules are nothing new.... they have been in place for years. If people have gotten away with things like this before it was only the shop assistants incompetence towards RSA that allowed it.
Aaron
6th July 2008, 09:54 PM
To add to what Mitch said.
Those fines are for the first time. They go up the next time. Once you get done, you get liquor/police/Today Tonight sitting 500 meters from the venue with cameras waiting for you to take the bait. Ive seen it. Infact, from the managers perspective, the fine isn't that bad part, thats just merely the cherry on the top.
Keep in mind also, the people that served you were on camera, possibly been watched in the venues cash room by duty managers etc.

Also adding to what mitch said - That is why you never leave the house without ID. Ever since I was old enough to carry a wallet with school ID or even a library card, dad drilled it into me to never leave the house without it!!!! The biggest wake up for me was having to pay an adult fare on a 2.5 hour train ride and not the student fee all because i forgot my ID.... makes a difference when you are a school kid with no job.
And I agree, fair cop for refusing service but having the tat on the hand was pretty good and the cashier should have known the legal age for tats.
CraigE
7th July 2008, 03:01 AM
Yeah, But as though you would take the kid into the shop if you were buying alcohol for them.
Stupid, stupid laws. If someone is buying alcohol for kids they should be held accountable not the shop proprieter.
Australia has completely lost it with these types of laws.
Like the bikie legislation going through in SA. I am not pro bikie at all, but am a bike rider and these laws will affect all people that like to ride in a group, not just clubs and gangs. What happened to freedom of association as in the constitution??

well there you go
I have just had phone call from a gentleman from Qld liquor licensing....he has said there is no law that states because my daughter did not have her ID that I could not be served. He said they can refuse service for other reasons but not that one. After I told him how she spoke to us and what she said he has told me that he will be contacting the Liqour Barn to calrify the law with them and will sugest that the Manager have some training in people skills as well.
So a e-mail can get results.

Just to clarify what I meant, its irrelevant that she want buying anything, in the eyes of the camera if she selects an item, then it belongs to her. Doesn't matter who goes to pay for it. I would still sell you whatever you selected though, although some people would not.

I tried to always buy the alcohol for my underage children, as I let them use my firearm and drive a car, this way I have some control over what and how much they drink. This is how you teach responsible drinking, safe shooting and hopefully good driving, this stupid idea that at a magic age you will be able to handle all this without any experience has been proven wrong many times.
I am not talking about serving alcohol to 10 year olds, but a beer or two at 15 never and never will hurt anyone. But a bottle of vodka at 18 will.

Most of Europe for that matter allow some sort of drinking at 15.
Its only because we want to be a mini USA that we are at 18. Hang on for a rough ride because it will be 21 soon if certain factions have their way.

Nothing to do with him. Myself and two friends were carded at one of the big bottle shops in Woolloongabba (Dan Murphy's?) a few years back. Only one of us was buying anything and he was the youngest in the group at about 26 years of age. Older than the girls serving from memory.
