I'm not aware that it's a legal requirement to have one. A loose one would certainly be a fail, but I can't see how none could be a fail.

Plenty of new vehicles come without one these days, so it shouldn't be an issue.
But then again, some might take the view that, if the vehicle was originally fitted or supplied with one, it must be there. Might have to get some advice from the relevant authority on that one.

not sure if it was original equipment as it would of been delivered trayless..
when we bought it it came with one but was unregistered, hence the question before the pits..
Thanks

Hi, there are heaps of local trucks around here which don't carry spare tyres - they have a contract with a mobile tyre joint. I don't see how it can be a necessity. Just in case, give them a call. Good luck - I hope they aren't as tough as in NSW.

From memory, in Vic if the spare wheel was originally fitted it should be.....fitted.
I know that when I was working at 1 workshop the boss failed a bloke that had a flat spare and so the bloke thinking it was the solution went home took it off and brought the car back minus the spare.
The boss.........charged him for another RWC and failed him again.
This was 18 years ago though so things may have changed since then.

There is no requirement for a spare to be carried/fitted in a vehicle. In general motoring, the fact that you have a blow-out or puncture is your problem and you wait at the side of the road, fo a tow or repair.
Many commercial verhicles, particularly fleet owned trucks used in metro areas don't carry spares because they get lost (or sold down at the pub) and are a very expensive item if you consider that a fleet of 50 trucks will have a value in their spare tyres of well in excess of $50,000. It is cheaper to have a pool of tyres and send out the mechanic/ or use a tyre service than to have a spare with each vehicle.
If the spare is fitted it must have legal tread and be secure in the vehicle for rego inspection.

Steve is it out of rego by more than 3 months?.I changed my defender rego over last week and all I needed was last years papers and a WA license to switch over.No inspection needed. Pat

Diana is correct. Many heavy trucks were supplied new without a spare or a carrier, or with a spare rim only. Leyland were an exception. Many fleets buy new vehicles without and expect a credit for the non-supply of the spare tyre & wheel assembly. If fitted the spare must be roadworthy and secure.

From memory the rangie didn't have one when it went over the pits.
The smart cars sold by bmw have no spare
Smart cars how do you fix a flat tyre without a spare wheel? - Yahoo!7 Answers (http://au.answers.yahoo.com/question/index?qid=20080506070232AAfrOC6)
If this is right then i suppose we can assume
It is not illegal to not have a spare.
But it is probobly illegal to have an unroadworthy one.

Don't know about in WA but in Qld you don't need the spare. If you do have a spare it doesn't have to be a roadworthy one (until you use it). It would need to be secure though.
My Rodeo went through two roadworthys and a Qld Transport inspection station with an unroadworthy spare.
My Disco went through a roadworthy inspection with a roadworthy but different size spare (although the road tyres were over size so maybe he didn't look too hard).
I was told by one inspector that you used to need a roadworthy spare until the new cars came out with space savers or just the repair kits.
