If this is a just fitted - I take it it is - tranny then with the fluid at such a low level I'd be inclined to ring the guy before doing anything. Once it's refilled there's nothing to see so he can wash his hands of it. It seems likes there's been a monumental stuff up by him so I'd be onclined to show him as it is. That might mean he comes to you or flat bed it to him - at his cost. This then secures your warranty now and in the future.
I bet that if you do the "lazy" cold check you'll find that the oil level will appear correct.
check it first thing in the morning before you start it up...

That he did the lazy check without the engine running etc?

I trust my Landy mech to get it right at each service. My carport is angled and the next morning without starting the car I just pull the tranny dipstick and note where the level is. I do this when ever I check under the bonnet which is pretty often.
The level of fluid is always way high and I know that this is an erroneous reading but the important thing here is that it doesn't vary from check to check. This way doesn't measure but what it does do is tell me there is a problem if there is a variation [up or down] on my artificial/erroneous mark.
And from service to service and day to day it is constant so there are no fluid quantity problems ie leaks.
yep the guy who filled it (likely an appy who doesnt know better at a guess) filled it and checked it like an engine.
Ive had cases with the busmaster where a couple of steerers have checked the oil while it was hot then in the morning filled it up while cold to the hot fill level....
I was told by the guy who rebuilt mine (does a lot of ZF's) that its better to overfill the ZF 4-HP22 rather than under fill it. The reasoning was it has a breather so will throw out the excess fluid it doesn't need :confused:
good plan, its so much easier to get at the gearbox after the vehicle has burnt to the ground.

Forgot to update this thread.
I chose to top up the fluid to factory specs.
It took 700ml
I told the repairer why I did this.
He was a little concerned that it was now over full and recommended that I have a look at the stick when it is hot. I said why would I do that when specs say check it cold. He just appears to have a worry about hot fluid showing over the max cold level and wasnt convincing as to why this is a concern.
But he didnt think adding the 700ml was any issue and he thought the 'excess' would blow out the breather ( which it hasnt of course)
The box is feeling good, warranty is intact..so all good so far 2500km later.
