don't pay the bill!!

I would advise not to pay the total amount of the invoice. He is entitled to payment for some initial work done for diagnosis, however he failed to correctly diagnose and indeed did not fix the problem you requested him to fix. In essence, he failed to fulfil the verbal contract to fix your car. Under consumer law he is not entitled to any further payment. However, in a show of good faith give him a first payment as arranged and then tell him that is all he gets. I work at a Toyota dealership ( and that is why I keep my Disco!!!) and we are very aware of verbal contracts or Repair Orders where we fail to fix what is required, if we fail, consumer law tells us we are not entitled to payment. We do ask for a token payment for some labour but would never expect to be paid $1600 for doing nothing to fix the original issue. It really makes me and my colleagues cranky when amatuers try to fix something they are not qualified to do and then ask for payment that is just way to high!!

:)I made the decision to pay by instalments [on pension days] and not pay the last payment. On receipt of the one marked 'FINAL' the proprietor fired back a poorly spelled email rant and finished by saying "I will see you in front of a judge!":o
I had posted a letter 3 weeks prior to that requesting him to review the labour costs with a clear set of reasons why. I asked him to comment on that by phone, email or letter in a non abusive way. Naturally I received no reply.
One would think that as he got 80% of his wildly excessive bill that he would quietly fade away but bullies find that hard to do. I assume that this will be the end of it but will refer the situation to the Office of Fair Trading otherwise. Commentary from them weeks ago suggested this. So thanks to all who offered advice during this whole unnecessary saga.
