In the purest sense it does make your vehicle unroadworthy, as it is removing the pollution gear that the vehiclen came with.
That being said, with the full kit that you are contemplating purchasing, only somebody who removes all the engine covers and is extremely familiar with the TD5 would ever know that something was missing. It looks like it is meant to be there after it gets a bit greasy and dusty.

I pulled off the intercooler hose to the intake manifold and found what appeared be oil inside. I also took the air box cover off too look down the pipe and there was what appeared to be oil in there as well, it was on the turbo fins also.
It was liquid, i assumed the gunk that gets into the intake on a TD5 was the same as on non turbo petrol cars, the sludgy black stuff and sometimes a little bit sooty. I expected to find the black stuff in the metal flexi pipe that goes from the EGR valve to the exhaust inside the intake manifold not an oil like substance.
So i'd really like to know if this is from the EGR system, or should I be worried the turbo is leaking.
I would think that if it is in the intake and turbo fins it will be from the crankcase breather which is half way down the tube between the MAF and Turbo. Do a search on Provent.Quote:

There will always be some oil there.
The EGR will only affect the inlet manifold, and possibly gunk up the MAP sensor. A good test is to remove the MAP sensor and see how much carbon gunk build up there is. If there is a lot , clean the MAP sensor and remove the EGR valve and clean it as it will be gunged up also.
I must say I am agonising over removal as when I bought my D2 with 134KK on it the the EGR valve and MAP sensor were dirty but not so much that the MAP reading was affected.
Seeing it took 11 years and 134Kk to get to that point , I don't consider it too much of a problem.

Fit the blank where the EGR duct joins to the exh manifold or cooler.
Plug vacuum modulator tubing to valve.
Job done.
No body will ever know.
