    When your employer goes belly up, who gets paid first?

    My employer is late with paying wages and super this month and on digging, info has been found that suggests the ATO is about to liquidate the company.

    If this happens who/what gets paid first - wages, super, ATO, Creditors?

    Happened to me, Tax 1st, Banks 2nd along with the liquidator costs/fees. then Employees, then other creditors like suppliers etc.
    I waited 2 years to get my holiday pay and entitlements.

    yeah mate, you're almost on the end of the queue, you probably wont get your super....are you a unionist? if you are notify your union immediately, they WILL put things in place in your favour.

    No union here. We are investigating our options for our futures. I am owed a fair bit of super though

    May I suggest , if your occupation is covered by a union [and just about all are], someone contact said union and give them the details. Unions are a bit like life jackets, most people refuse to wear one, but when the ship hits the sand, sometimes it's all you've got.They have a purpose. Bob

    The Crown lost it's priority some years ago, so the ATO rank as an ordinary creditor. That's they're more aggressive in debt collection in recent years.

    If super for Mar-June quarter isn't paid by now, complain to the ATO now. Current super isn't due until early September. You may or may not get it, and it will take a while but don't delay.

    As to pay & entitlements, you may or may not get 100c in the $ by a liquidator/administrator. Too many variables to say further.

    If you don't get a group certificate, you can still lodge a tax return with an estimate of income and what the PAYG should have been.

    You will still get the super that is already in your fund. If they have paid some of your wages and not deposited super, that will be a chargable offence, however if they are behind in your salary and will not get it then the associated super may be lost.

    Check the legislation in your state - in some areas workers wages (or at least a proportion) is guaranteed by legislation (over other creditors) but I am not sure where this applies.
