the cop asks her for her licence. she replies shes 15 so doesnt have one.
cop states that keys are in ignition, shes the only one in the car, therefore shes driving without a licence and driving while using a mobile phone.

common sense prevailed and the magistrate threw it out of court but at the time it was the stupidest thing i had seen a cop do.

Again, in Victoria, a fellow was having a good evening in The Chevron (a nightclub in St Kilda Rd.). Expecting to have an even better morning, he wandered down to St. Kilda Rd. police station and asked if he could leave his car keys there for collection later as he didn't want to drive home whilst well over 0.05. The constabulary there decided to breath test him and charge him with being over 0.05 whilst in charge of a vehicle. The argument was, because he had the keys, he was in charge of the vehicle.
Never met the fellow after so I don't know what the resolution was.

However, if you sit in on country court cases, it's surprising how many police get chastised for wasting the courts time.

BTW A GPS gives a lot better directions than SWMBO.

Well tell your GPS to avoid dirt roads - it is in the options for most GPS (well certainly the ones I have). Most of the issues people have is because they do not know how to use their GPS and do not have it programmed for what they need.

So if I enter an address on my iPhone maps app select the go to button then get in the car and place the phone in the cup holder in the centre console, start the car and follow the voice prompts to my destination without touching the phone I am guilty of an offence?

But if I have an A1 paper map open on the passenger seat and look over to it to see where I am I am OK?

I agree that you should know where you are going but as an example I have strted a new job out in western Sydney and do not know every street so I rely on the GPS to help me get to my next job. I find this much simpler and safer than trying to fiddle with a street directory.

Some common sense must prevail surely - hang on government and loonies like Harold Scrubby and friends - no wait it all makes sense to me now.

You can get John Cleese to do the voice directions on the TOM TOM
TomTom GO 300 review - CNET

You know what the irony of this rule is, in my D4 (without Nav) I don't need to touch the phone to answer a call or to look up a number and dial it. All the needed phone functions are on the car's screen or steering wheel.

But if I use the GPS or Google maps I have to touch the smart phone.

Judging by the way some people drive I am sure this option is available and well used.
