    If you get a parcel sent to you by mistake, can you keep it?

    I ordered a small part for my welder from a Sydney company.

    About a week later, TOLL dropped of a marvelous (and massive) inverter welder that looked like it was worth $3-4K. Industrial!

    They delivered it to my missus' workplace, and she just thought I'd bought some other bit of machinery, so she accepted the delivery.

    Of course, the company who was expecting a whole welder got my small part, and wasn't all that impressed

    If you end up with a 'windfall' like this, are you under any obligation to hand it back?

    I think you are and its a hard call, part of me would want to keep it but i would probably feel guilty and notify the sender of the error -

    Whilst not 100%, i'm pretty sure you can be charged with theft by deceit ( or something similar). Really depends on whether the company chases it up and that wouldn't be hard using tracking and order numbers.

    Depends if you want to sleep well at night......

    You may end up with a bill for the welder

    My BIL once laid carpet in the wrong spec house.He never got the carpet back or got paid for the job

    I think you could be charged with theft, knowing full well that it is not yours.
    If a bank deposits a million dollars into your account my mistake and you don't give it back you face charges, even though it was there mistake.

    Now can I have my welder returned. It must have bben delivered to you by mistake. Oh those courier companies.

    Just to note: we did ring them and let them know there was some sort of mix up.

    The courier came back the next day and picked it up, but I was just wondering where you (legally) stand if you said - "Your mistake - I'm keeping it!"

    Given that it was a few thousand dollars of kit, I'd be guessing they'd try pretty hard to get it back. If it was just a $50 item, then less inclination to recover it.

    So.... Theft by Deceit I'll tell the missus.

    Many years ago my dad ordered me a Banjo, yes I play but a bit rusty now
    It came from America and they sent the top of the range gold plated one not the chrome one he ordered. The one we got was a LOT more expensive, dad range the company and they at first wanted us to return the Banjo, but costs of postage etc they decided to let him keep the banjo. Actually I always wished we got the one he ordered as over the years some of the gold plating has worn off, but this would not have happened with chrome..
