If they weren't specifically told in writing they couldn't smoke in the house, then that is fair wear and tear and not covered as far as damage goes. Tenants have more rights than landlords these days - the new legislation has just come into effect too, so tenants can do all sorts to the house now without permission and have pets too and the owner must apply to VCAT if they have a reason to refuse this - "They will wreck the house and gardens" is not a valid reason.
They can also put up pictures by using nails, hooks, whatever without permission and it's considered fair wear and tear. There hasn't been a limit set for this, so of course there's already been a report of a tenant putting 100's of nails in the walls of a house because they can...
They can put up "wall mounted shelves and brackets" without permission as well - no limit, just not on brick walls, hardware mounted child safety gates and other safety devices like wall anchors for furniture, etc.
The landlord was due to paint anyway. Fifteen years, how much other maintenance has been let slide?
