    Broadway Multistorey Car Park Sydney - General Damage Q

    Guys and Gals,

    Dont what ever you do go to the top of this car park.....you will be in for a nasty shock on the way down.

    Wife was out last night and went to the top part (near the cinema entrance) clearance is all fine for a D90 have been going here a lot of times.
    However on the way down one of the overhangs from the ceiling took out a chunk of the back roof

    Cue long and protracted exchanges of names details etc etc etc with the parking attendant downstairs.

    Has anyone else been invloved in a car parking height incident anywhere and if so was it fairly easy to get the buggers to pay up?.

    It looks to me like this one is going to cost quite a bit as its flattened the lip out on the door side as well as the roof...plus the paint etc etc etc.
    And Im not going to be the one that picks up the tab....so to speak.

    Hi Expat,

    Sorry to hear the news.

    Whilst there are always disclaimers these do not always stand the test.

    I know of a case where a 110 was damaged whilst exiting the Megamart at Alexandria. The plaintiff won.

    The claim of minimum height clearance can be tested by an Australian Standard (probably this one: AS 2890.1-1993 : Parking facilities - Off-street car parking). They are revised occasionally.

    So if a height restriction is declared at say 2.2m and your vehicle is below that then you have a case unless specific area warnings are displayed.

    Im more than prepared to take the case to a lawyer if these guys dont play ball and settle to pay the damages outright , Im also going to let them know that in no uncertain terms.

    As you actually enter the multi-storey there is a height bar marking at 2.00m so thats fine , and we have been in there on many an occasion without problems.

    Im just thinking theres been an overhang on one ramp down that has now only dropped enough for us to catch it,if it was a general height restriction the whole back would have been chewed rather than the back right corner.

    Will let you know how I get on.

    Afew years ago I had my Disco damaged along 2 doors and quarter panel. The Disco had been parked at a 5 star hotel in Adelaide - Stammford On Grand. We had used the valet parking service at additional cost. It ended up they had parked it in a breezeway because it was alledgedlly to high. It looked like a trade vehicle had side swipped it. On first inspection they tried to say it was there, which it was not. After discussions with the duty manager he did admit liability and said it would be taken care of when we got home to WA. After quotes etc had been obtained their corporate lawyers got involved and refused to pay up. I was informed by the department of consumer affairs in Adelaide that I would win the case in small claims court easily, but I had to return to SA for the hearing. In the end my insurance company paid it and I the excess as it was not worth the cost of another trip. At a $400 dollar a night hotel I think it was pretty poor.
    You should have a case.

    The 90 height is specified as 2.076m with the 235 tyres and 1.933m with the 205's.

    The case is weak if your's measures over 2.00m. I suggest that you get out the tape measure on the vehicle and also the spot in the carpark (measured at right angles to the slope of the driving surface).

    If yours is over 2.00m then that could be a problem unless the spot is under 2.00m. Then you might have some legs to stand on.

    Is not the bar or chained sign supposed to be at the exact height of the lowest point in the carpark? This is supposed to actually stop you entering the carpark. It did in Adelaide with my brother in laws Nissan. Touched the sign so back out onto Hindley St in peak hour. That was fun. Ended up just going and if any one wanted a Nissan as a hood ornament they could keep coming. I think regardles as long as you did not hit the entry bar/sign on the way in you have a case. I am certain most people do not know the height of their vehicles exactly. With my racks on I will not enter anything below 2.3metres.

    they seem to move up and down with age.....

    i guess a link comes off the chain every time someone rips them out.....

    Sections of the broadway car park are 1.95m. I think those are only the very bottom levels, but the chain and pole at the main entrance is set for the height of the rest of the car park.

    Good luck getting the money out of them.

    I'd be terribly disappointed if you didn't. Every time I drive through a car park knowing exactly how high the 130 is I imagine the vengeance I'll reap upon them if they've made a mistake.

    It comes over me most particularly on speed humps installed after the car park was made, and when they're adding new plumbing.

    i remember a carpark had the sparkies in once to replace all the flouros
    after a 4wd had smashed them all with its aerial.......
