Currently I have paid 12k for an RRC that was meant to have mod plates. Turned out it wasn't even cleaned for delivery of the sale. On pick up the car did not have the plate on it. Had been promised to have them sent - still don't have them. I should have stood my ground and demanded my money back right then and there.
Said person had 6 weeks before I picked it up to find them - he didn't and now all I get is story after story and now I have to engage legal peoples go the fraud route.
Why do I have to do this? Because right now I have a 12k car that I can't drive at all. VIC requires that any mod'ed car needs to have its plate fitted. I just avoided a fine for this.
I can't change the car in to my name either as the plate is needed for a road worthy.
So many times I was told be said person that it was perfect and would pass a roady any where etc etc - this wasn't even close to the truth. Let alone the filth I have had to clean out of that car over the last week while waiting
for the mod plates.
Under common law the person is bound to not mislead the advert or sale - in which case both said the mod plates will be included.
But what would you do?
The very first thing I would do would be to ring CAV. 1300 55 81 81. Unfortunately, you have far fewer consumer rights when buying privately, but CAV is still a good source of advice. Depending on the type of sale, you 'may' be able to make an application to VCAT. CAV will be able to tell you more. You have nothing more to lose than the cost of a 'phone call.
