trade in a car and get speeding fines after

I sold my soft-dash RRC to a bloke from NSW and allowed him to drive it away with the plates and about a month's rego, 2 years later I was getting speeding fines and unpaid Sydney toll notices. On the advice of a police sergeant friend, I completed a statutory declaration stating when & how I disposed of the vehicle and what identifying details I knew of the buyer. I sent this to Vic Roads, never heard anything further and no more fines. I've sold 3 vehicles since then without RWC, each time the buyer has asked me to let them drive it away with the plates and each time I have declined. It's easy enough for anyone who intends to do the right thing to get a permit from Vic Roads and they can then do it all legally with no risk to you. Surprising to hear of it with a caryard though, I'd be pretty peeved if they were sending a car out for test drives with my name still on the rego.

Dealers in Qld. don't need a Safety Certificate to acquire a car. They do need one to sell it at retail. Just too much trouble and paper to transfer it into their name. Lazy buggers.

I have had 3 run -ins .
I bought a Jackeroo from a dealer in Queensland then moved to NSW.
handed in plates and went to register. No Way , encumbering in Qld.
Got onto Qld government and complained. Told was sold in Auction to dealer then by dealer to me. Title should be guaranteed TWICE. I was able to find it was a lawyer in Gold Coast who had encumbrance. Rang her and asked to lift encumbrance and was basically told to **** off.
Got onto Qld govt and eventually cleared title but took about 2 weeks.

Had black Honda Jazz written off in nose to tailer. Insurance company asked if I wanted to remove plates or they could do it. I said OK you do it. Couple of weeks later get bill from M5 operator , no tag. Huh? Cleared the bill by sending write off documents, but still it must have been billed while on the back of a tow truck. If a next time I will definitely take the plates.

Third time bought current Jazz. Dealer advertised including Govt charges but negotiated down and I understood that I was to pay charges. Went to RTA to pay stamp duty and told already paid. Great. Rego ran out a couple of weeks later and went to pay. No way. you have to pay stamp duty. Huh? Dealer clerk had made a mistake but get this. The dealer was able to reverse the transaction in the RTA computer! I was amazed. Imaging what a crooked dealer could do if able to change the RTA computer.

Friend of wife recently pulled over by cops for unregistered vehicle. Fine is BIG in NSW about $800. She had bought the car from a dealer on understanding rego to be paid. Dealer didn't do it. It took her a while to clear it up but eventually didn't have to pay.

As I said before, whether buying or selling, ALWAYS tell the motor department in your state. If you tell them, you should be covered even if the other party does the wrong thing.

Sorry not quite following this.

In the ACT and I think NSW and I thought in all states there is a section on the registration document that when you sell the vehicle you fill it out and rip that section off and send it into registration authorities and you give the rest of the rego document to the buyer.

Looking at the back of my rego document it says:

"NOTICE OF DISPOSAL

Complete this form and email to .......... or Post to .......... (Registration Authority) when the vehicle is sold. Do not give to the Acquirer. If you do not provide all information, we may not be able to process this notice and you will remain responsible for the vehicle including any infringement notices received"


So is this not also the case in Victoria - seems to me the seller just handed over the entire rego document rather than removing the seller section and sending it in.

Sorry no sympathy if that is the case.

I have a similar issue right now. So I wanted to see what you needed to do to transfer it online. In Queensland the seller can transfer the rego if you have an electronic safety certificate. If you have a paper one, you need to go into a TMR office with the paper one to get an electronic one issued.
Anyone else see the flaw in this online process?
