Police have to prove you are guilty. Most people cant be stuffed going to court over a driving offence. I reckon more people would get off if they did go though.
If I remember correctly, The Police fine you, we will say $85:00 you write them a cheque for $100. By law (if I am correct) the must refund you the change so that would be $15. If you DO NOT cash the cheque that they send, they cannot proceed with the processing of the fine, but they cannot do anything about it either as legally you have paid, only they cannot process it.
