I have had a further think about this, & a look at my diaries, & a few 'phone calls. After this case, most dealerships would no longer use "New" on an invoice, except a pro-forma invoice presented to a lender. Commonwealth Bank was insistent on the use of "New". The actual sales invoice that transferred ownership of the goods was then a description of the " new" vehicle, giving make & model, identification numbers, options, accessories, modifications, add-on costs, etc. included in the price required to be paid before delivery. but NEVER described the goods as "new", or the fitness for purpose. ( Sale of Goods Act covered fitness for purpose anyway). Used machines were always invoiced as " Used or second hand goods, sold as inspected or accepted by the purchaser or their agent/s.
