Now assuming you just recover someone for free it does not negate liability should you damage/break/maim someone during the recovery.

I spent January rescuing trapped vehicles for the SES...
But people too plain old stupid, and who drive into a flooded area when they could happily wait a while don't deserve free assistance..
Genuine mistakes/misfortunes OK... But stupidity should not be rewarded!
I've recovered several vehicles, 1 had the front destroyed in the process due to his positioning/predicament... He was told not to go in there but insisted...
He had no recovery gear, no rated recovery points etc... yet continued on...
When he walked back asking for help we went in, in front of witnesses he acknowledged the risk of damage and we began the extraction...
Cost him a new front diff and a new front bar...He was stuck that well.
He was ok with that, and the fact that should any of my gear be damaged during the recovery he WOULD pay for it.... (I got his D/L details, rego and witnesses)
And you have been on the over end as well and did,nt complain about the service or the charge that was asked (well not asked) or expected a simple thanks was well received by all and no one complained:DQuote:

I have recovered heaps of people from places they shouldnt be, a logistical hazard when you live in Merrijig, not so much now im in Cranny but still have got the odd call from freinds that of course I dont charge.
I have only charged for 1 as I broke a snatchy that id borrowed of my dad and broke a winch cable and dented a guard on the 2a draging him out on a drag chain, I charged him the $80 for the snatchy that he didnt have on him but called in the next weekend to drop the money off.
There is nothing wrong with charging for services rendered, that is why we go to work every day and for this sort of thing I think there is a pretty destinked line between being stupid and impatient or being in a bad position and needing to go through to get out of impending danger.
If it is just impatients then $100 isnt enough, I would tow and impound the vehical until $1000 was paid but if it was a matter of rising water and if they didnt go now they would loose the lot then I would do it for nothing unless something got damaged but I would always state clearly that any damage will be paid by them on either vehical in either case.
So no one has answered my question, just say my family and myself were stranded km's from anywhere, we have no money on us. Do you leave us stranded with kids and a broken car because we can not cough up the cash?
By the way, when I recovered the D3 on the sheepyard weekend I didnt ask for anything, he asked me what I drank so I told him and he came out with 2 slabs.
If I knew where they were and how little they were prepared for being there I should have said $1000 or lots of slabs of bundy or beam.
They were down the bottom of a muddy track which was not only steep but deeply rutted in spots and you could see the drag marks where they should have tried turning around on the cut aways rather than continuing.
Even at the bottom there was plenty of room to turn around on some stable ground but they continued to try to go through the creek which resembled a mud pit.
I was expecting to see a well set up D3 which just needed a bit of help but when I got there they didnt have a stitch of recovery equipment and on road tyres.
They were good blokes and they insisted on not getting me muddy and did all the hookup etc with me viewing on to make sure it was done to how I wanted it and they did have excellent recovery points and new where they were and how to access them.
i wouldnt, but having said this, had you driven somewhere knowing there was the possibility of getting stuck and ignored the warning signs or went against better judgement because you were in a hurry i still would help, but i would tell you that you were a f-ing idiot for doing it.
I think its against someone's moral character not to leave someone stranded like that. I wouldnt so much ask for payment but if the person offered me money at the end of the journey i wouldnt say no. I also dont think i could say give me $100 or i wont recover you.
No, I'd tell you the charge and hope that you'd cough up at a later date, If you didn't that would explain the reason no crunt stops anymoreQuote:

I generally pull up and help EVERYONE, but a slab of cans is usually going to be the cost:p If you don't like it, you can simply tell me to **** off and I'll leave you to your on devices:eek:
And yes, IF i ever needed the same, I would be giving you a box of beer regardless, whether you asked or not.....Or 100bucks if I was in the same boat.......without moaning like a women:mad:
as would i, if it was more than just a simple snatch recovery or something and it took the person recovering me i would offer some form of compensation, i think that is equally as much of a moral thing to do as stopping to help the person out. MattQuote:
