Very interesting topic and issue we have here.

Unfortunately if you defame someone. Then someone has to be liable. In this instance it would be the site that would get blamed for the defamatory remarks. Given this if a person or company decides they didnt like the comments or there is 1% of misleading or untruthful content then the site is liable.

I know myself that the moderators have the best interests of the members at heart and sometimes i dont agree with the rules. However lets take it the next step.

You are accused of a dodgy repair or service and suddenly there's a slightest drop in turnover due to a comment or whatever made in the public area. How would you react your reputation has just be tarnished because someone may have a grievance with you. But the person with the grievance has taken a cheap shot because he can hide behide a web forum.

Simply solution to the issues vent your dislikes in PM or get the facts right

I once fitted a fuel injection pump to a toyota bus, the bus would not start and the boss looked at me as I fitted the pump, so I come in on my weekend and pulled all the timing cover back off and to check the timing it was perfect. the problame was the boss stuffed the fuel settings up on the pump.I knew the pump was timed properly but the boss said that it was my stuff up so I turned up to save my reputation and to prove my point.
It's about reputation and if you have done the customer injustice and don't fix your stuff ups then you deserve to get ragged.

I disagree, but I can see your point though as it could get out of hand and be blown up into somthing bigger than it should.

Remember that this site is not a democracy. Nor is not taxpayer funded. Nobody is obliged to register and post. Therefore, it can set it's own rules and there is no legal or moral imperative to accept any direction other than that of the owner.

If you don't wish to abide by the rules, then by all means suggest changes, nobody is saying the situation is perfect. But if those changes are not accepted -- and remember there is no obligation to accept them, then be quiet or start your own forum.

I agree, we sort of forget that rules do apply while we are on here. We follow them or if you disagree you are free to leave.

We all get on here an vent frustration on a variety of issues, we seek advice and discuss things. I think if you really need to payout on some company or person for a bad job then call a mate.

If the company consistently sucks then they will get a bad reputation regardless of what you may post on here. No need to put the forum at risk by venting your spleen on here.

It does pose the question though, what happens when people are after a recommendation. That is something a lotof people come on here for...a referral to a good mechanic or some other specialist. How can we give people advice without defaming the company. Does any sort of bad feedback become taboo?

Perhaps we just have to say things like "I wouldn't recommend them" or "I had a bad experience with them" or "Their customer service is bad"?

While I think you should be able to have free speech and explain in public your experiences with a retailer, it should only ever be done once there is a conclusion to the matter between the two parties and not as leverage or a rant.

At the end of the day, if a retailer does not do or supply what he advertises, it is tant amount to fraud and should be exposed IF he decides NOT to rectify the problem, if it was indeed the retailers fault. However the retailer deserves the right to respond. The retailer should be then advised of the post so if they wish to respond they can. The thread with just the two posts should be locked so no comment is allowed and people can make up their own mind. The original post would not go into the public domain until there are both sides of the story or the retailer decides he does not wish to respond.

In these times it is the best interest of all to make sure the market place is fair. Retailers that do the right thing will be rewarded and those that do not will learn.

As to the liability issue, this could be overcome by a waiver to be returned by all parties and added insurance cover for the site.

If the members of the site decided they would like this sort of forum, there could be a fee for the ability to post the complaint to cover the cost of the added insurance protection. This would also weed out the true complaints from the bull**** ones.

I also realize that this would take a lot of work and may not be something the owner or mods wish to do but it is an idea to consider.

Another way around it would be to just say "I had a bad experience with a retailer in "X" state that provides {insert service type} . PM me for details.

There are ways and means of expressing your opinion without being rude or defamatory, and still making the point. For example, avoid absolutes, swearing and personal attacks.

Try a factual listing of the experience, avoiding subjective opinion.

Like I said, imagine you had to read it to their faces, or to a judge and jury.

Then consider posting.

i think it would be very much helpful to those, if people actually recommended businesses on here in the recomendation section

......then when people are looking for a service they can look in there and see who people DO recommend. that is one way of helping people aviod the not so good services

just for ****s and giggles, what about all the criticism that has been levelled against Landrover on this forum in regards to the various faults in the different models?
