    Have I been E-Bay scammed?

    I just won and paid for this freelander on E-Bay yesterday afternoonhttp://cgi.ebay.com.au/ws/eBayISAPI.dll?ViewItem&item=280396812368&ssPageNam e=STRK:MEWNX:IT#ht_500wt_1182
    Only to be told this afternoon that it's just been side swiped by an 8 ton tipper in the parking compound at his work(why was it even at his work?).
    So is he just disgruntled at not getting the price he expected, and lying to get out of it?
    and, what should I do? He's meant to be refunding my cash tonight via PayPal.
    Should I ask for photos?

    Just spoke to the fella again. Reckons it's on a tow truck, I said I'm happy to wait for it to get fixed, and can he send me pics tomorrow of it, but still refund my cash for now.
    I guess he could be telling the truth, just seems a bit to coincidental.

    You just dont know really with Ebay... does sound coincidental but photos should prove it.

    Get someone else you know to ring them and enquire. He says it's advertised elsewhere, so they should use that ad as their reference. If he offers to sell then report him to eBay. Once an eBay auction is finished it is a binding contract of sale and if they are scamming you because they didn't get the price they wanted then let eBay throw the book at them.

    You should insist that you go over and inspect the damage right away (don't wait for photos) as it is technically now your vehicle since you've already transferred the money.
    There has been an offer, acceptance and consideration paid... that's a completed sale.

    Yes, that's the correct link.
    I lodged a dispute with PayPal, just so his account would be frozen until he refunds. I didn't want to do it, but with $4000 paid from my credit card, I couldn't risk it.
    I can't afford to take another day off work and drive for another 3 hrs to go check the damage, he'd tell me it was somewhere else anyway if he is lying.
    Oh well, it was a pre 2000 model anyway, and probably had the inherant drive problems with the differently geared front to rear.

    I hope you are not relying on ebay to watch over your interests because they don't. They are a waste of space.

    I would be raising the issue with your credit card company - they may be able to reverse the payment.

    I lodged a dispute with PayPal, they'll freeze his account until it's resolved. They're great like this, I've had them refund for a bike I bought that was a total wreck, and the seller was a total scammer trying all sorts of crap on.

    This comment probably isn't much help and I don't mean to offend, but why did you pay via Paypal? - I would be turning up with the wad-o-cash which can be easily re-pocketed. 10% deposit should be enough to hold it - and a lot less to recover. (I can live with bad feedback.)

    My experience using PayPal has been really good, as mentioned above.
    Also, by using PayPal, I can use my credit card as I didn't have the cash.
    PayPal said they'd have refunded my money even a month or more later in the instance of the cracked bike frame.
