bike rack on swing away rear tyre

Hi all.

How many bikes would I be able to hang of the rear of a defender swing away tyre system. I've got a standard bearmach type. I'm looking at getting one of these. Bike Racks, Carriers and Stands - Four Bike RV(4wd) wheel mounted rack but a little concerned. Taking the an average bike weighs in at 12kg and I have 3 for now..... well thats a lot of weight haning off the back.

Thoughts?

Is a pipe sticking straight out the back like that legal? I certainly wouldn't like to run into it...
