You'd have to talk to the manufacturer - but if it was an engine I made I would be about as suspicious of it as rechipping, since it offers similar opportunities for increasing power, which if this opportunity is taken and used, is very likely to break things that weren't designed or tested for the extra load. But most manufacturers work on the basis that any modification, particularly to the engine, voids the warranty, unless they have tested and approved it.
Under consumer protection laws however, it is unlikely that they would be able to sustain voiding the warranty unless they can prove the modification caused the fault - but you might have to take them to court about it, although note that the people you would be taking to court would be the dealer not the manufacturer; although the dealer might be taking them to court themselves, unless the manufacturer was bankrolling them. In any case, it is likely that you can afford less legal costs than either the dealer of the manufacturer, and you probably don't want to go there.
