    A person must not, without just cause-

    (a) remove or render ineffective any emission control device or emission control equipment which has been installed on or in any motor vehicle by the manufacturer of that vehicle; or

    (b) interfere with any emission control device or emission control equipment or any component of the engine or exhaust system or fuel system designed by the manufacturer to control emissions so as to render it less effective.

    Penalty: 20 penalty units.

    Penalty for interfering with noise reducing equipment


    <pre>
    22. Penalty for interfering with noise reducing equipment


    (1) In this regulation, noise reducing equipment means any absorbing material, shielding panel, device or other equipment of any kind whatever for the purpose of reducing the emission of noise from a motor vehicle.

    Note
    This includes, but is not restricted to, the exhaust manifold, the exhaust piping, the expansion chamber and the silencer proper.

    (2) A person who installs, removes, replaces or repairs noise reducing equipment on a motor vehicle must ensure that the vehicle meets the requirements of regulation 10 when the installation, removal, replacement or repair is complete.

    (3) For the purposes of subregulation (2), a person who installs, removes, replaces or repairs noise reducing equipment on behalf of another person is deemed to complete the installation, removal, replacement or repair on physically transferring the motor vehicle to the person on whose behalf the work was done.

    Penalty: 20 penalty units.
    1 Penalty unit is currently ~$122. So ~$2440 fine, or double that if they deem the parts you have removed to also be "noise reducing equipment".

    16 Motor vehicles emitting excessive air impurities

    An owner of a motor vehicle is guilty of an offence if the vehicle emits excessive air impurities while being used.

    Maximum penalty: 400 penalty units in the case of a corporation, or 200 penalty units in the case of an individual.
    A penalty unit in NSW is currently $110, So (up to) a whopping $44000 if your vehicle is registered to your business.

    It appears to come under defective vehicle legislation, which seems to be a maximum of 20 to 40 penalty units. Penalty unit is currently $100, so $2000-$4000.

    So if max penalty is $2440, the penalty notice would only be $150ish

    No - in VIC the penalty appears to be a prescribed amount, not a maximum amount - like a speeding fine - they are fixed amounts for a certain km over the limit.

    20 penalty units is the maximum penaltly available to the courts, it is NOT the amount of the penalty notice.

    The penalty notice amount appears to be $524. (Penalty notice amounts obtained from the "Fixed Penalty hand Book" not the legislation)

    20 penalty units is VIC - the handbook you refer to is a NSW document????

    No sorry - the amount of $524 is the Vic penalty for interfering with emission control device, from there penalty notice hand book.

    20 penalty units is the maximum penalty set by the Act and Regulation there under.

    Act/Regs do not quote penalty notice amounts.

    From all the penalty discussion, it is clear you could loose significant money for interfering with the decat functioning. But what do you gain and is it worth it?

    The catalytic converter restricts exhaust flow from right under the turbo, this increase the time it takes the turbo to spool up. So longer to get the boost !
    When I removed mine the difference was immediate and very noticeable. Much smoother power delivery and more responsive from idle.
    Worth it – hell yeah

    Hi Drover,
    Have you done the centre pipe as yet. I am more than pleased with the changes both pipes have made to performance and economy. The banker says no to the tune until the Puma eats another EGR so I have to be patient.

    Hi Allan,

    Yeah did centre pipe when I replaced the Decat.

    I like it, not much louder than stock, has made improvements to economy and performance.

    Thanks for the tip, it was a worth while mod.
