Re register a written off 130 NSW?

Gday all, long time no speak.

Not sure if this topic is covered here somewhere? I tried the search function but was surprised that nothing much turned up.
Anything else LR I want to know is pretty much always comprehensively covered; greatly appreciated too!

I still have my 06 130 that was written off in late 2020 and still can’t seem to part with it. However, I’m being ‘prompted’ quite firmly now and I’d prefer to remain married…….

I’ve posted a little about it on here before but thought I’d start again.

**So, I’m looking for real experience from folk that have been through this in NSW.**

    Situation is this:
I T boned an i40 (which totalled it, of course) with a heavy trailer on, my chassis rails are both bent up and slightly to one side, by around 30 - 40mm, in the first 3 - 400mm.
Front passenger side suspension damaged but easily repaired.
Bull bar and wing gaurds both knackered.

So as far as RTA is concerned only 2 strikes on the stat write off proviso.

Unfortunately I didn’t realise at the time that I had the right to send the NRMA (the other parties ins co) a letter of demand and therefore avoid the written off vehicle register. Re register a written off 130 NSW?

However, the NRMA insurance assessor refused to provide a ‘letter of damage’ after they wrote it off. Re register a written off 130 NSW?
I’m informed I can skip this step in the re rego process.

The vehicle is now over 15 years old, so I’m hoping I might be able to begin the process of repair and re rego that way?
Does anyone know if the RTA work the over 15 year rule from the date of write off or once the car is 15 years old, all is good to repair and re rego?

    My reasons are:
    - I’d rather not see one less proper Defender off the road and that appears to be the outcome if I don’t re register it.
    - Car has done very little hard work and chassis, running gear and rest of body is very clean.
    - Motor is good. Mileage is only just on 200k km, everything original except t case (high ratio disco)
    - Once I get the chassis straightened professionally, it won’t be a difficult repair.
(I’ll do it myself as I have an unmarked pair of white wing gaurds complete.
I’ll buy a 2nd hand winch bar and fit it.
I’ll do the steering and suspension with new parts as necessary.)
    - I can’t see repairs, rego, fees, etc exceeding $12k
    Any thoughts on this?

Vehicle should be worth around 30 - 35k when it’s back on the road (even though it will always appear on write off register)

I’d be really happy to chat, if anyone has been through the experience and has time to talk.

    Regards,
    Col Moore

I assume you have combed the RMS website for all the relevant info. On the brief reading I did, the written off rules apply to "vehicles" up to 15 years from date of manufacture (not as you put as the alternative, 15 yrs from written off register). How you go about repairing and re-registering, can't help. While it might not assist, I upgraded my 130's GVM to 3850kg and it puts me into the NB1 class (light truck not light vehicle) If stock, your 130 will be NA. Long and short, different ADRs apply to NB1 which might offer you an easier path to re-registration. comes at a cost of higher rego but I gained 350kg of pay load and I can call myself a true 1 tonner.

I bought a repairable written off 130 that was registered in ACT at time of write off, transported to Vic, repaired, registered and I bought it and transferred it to NSW. I had to be real careful to not let VIC rego lapse before the transfer to NSW rego otherwise the NSW WOVR rules applied. My story doesn't illuminate your situation.

best of luck, my tip is to chase rabbits down burrows until you find the path of least resistance. That means, going to the NSW regulations and Instruments and ADRs. Don't rely on summaries on the internet. Only the source document will give you the correct answer.

    replace chassis

    Just a thought...
When I first started refurbishing old vehicles (like Austin A40's etc), the only identifying numbers were the engine number and the chassis number, stamped on the engine block and chassis frame respectively.

The chassis number, as I understand, remains the primary number for identifying the vehicle, no matter what other items are attached.

    Engines could be easily swapped.

When the VINs came in, I assume associated with monocoque vehicles, the chassis number was stamped onto the chassis/body and a seperate (aluminium) VIN plate was added elsewhere, likely for ease of inspection.

I suggest (???) this aluminium VIN plate could be altered / changed so long as it corresponded to the actual chassis number.

My 1995 130 has a chassis number stamped on the chassis and a VIN plate on the windscreen frame ('body'). They're both the same number.

Could you consider buying a completely new chassis with new "VIN" and swap all the other items across.

Possibly $8k + but then you would have a new chassis as well as, effectively, a new vehicle without the historical "written off" legacy.

Having been through this game with a Jeep that came equipped with a mismatched VIN plate number to the VIN number attached to the tag on the windscreen frame and the number stamped on the chassis I can tell you that from the RMS perspective the VIN plate wins as the identifier of the vehicle. It would be different in a vehicle without a VIN plate I would imagine

I'm currently looking into a replacement chassis for a 130 that is NOT written off. The price of a brand-new galvanized chassis is surprisingly reasonable- about $4500- but I'm awaiting a shipping quote which may well double it. VIN can easily be stamped into a chassis. No idea how RTA would view this as you would be re-registering.

AFAIK after reading the NSW RMS rules some time ago, there are two instances when you can reregister a written off vehicle.
1 you own it and it is hail damaged and you buy it back from the insurer.
2 you owned and registered in your name the vehicle 18 months before it was written off and bought it back from the insurer.

I looked it up about 2 years ago when my car was a hail write off and I was surprised aboout the 18 months bit.
    Regards PhilipA
