No it doesn't need one.... yes it is better without one as it stops the Wastegate opening for longer, depending of course on how it is adjusted.
And of course it can be used to deliver the correct amount of boost /air flow (even though these are different things ) right throughout the rev range, to match the turbo flow map.
Put it this way, if I had a defender td5, I'd be trying to put a modulator on it.
No it doesn’t. But then you could probably also start to ask does the Td5 even really need a turbocharger or could it run without one? It’s there as part of the package that allows the same Td5 engine when fitted into a Discovery 2 to be more powerful than when setup in a Defender. It’s disconnected/removed if you upgrade to a VNT/VGT setup but otherwise you’ll have more benefit with it there and fully functional than without it. I’m not sure what your trying to achieve here - lighten your vehicles weight? Skimp on repair costs by not forcing out to replace yours if it’s faulty? Reduce your power level down to Defender Td5 spec?
I have to disagree here from my own experience.
I originally had my modulator with the shortened rod.
My boost limit was raised to about 22-23PSI by an edit in the ECU.
There was a post some time ago that the modulator is not ideal for pressures over its set opening of 15PSI, and I felt that it was sluggish to gain extra PSI .
I fitted a Turbo technics? valve and bypassed the modulator completely.
I noticed a much quicker rise in PSI OVER 15 psi now and I have it set at 22PSI.
My theory is that when you shorten the wastegate rod, it doesn't allow the wastegate to fully close, but this is overpowered by the boost increase, but some boost is still being shed by the wastegate being partly open.
What alerted me to this was that the modulator to wastegate tube had a hole in it on one trip, and I noticed fabulously increased boost ( up to 28PSI on occasions) and cooler EGTs so I thought I would try a manual boost controller.
I think the modulator allows the 16P engine to make more boost under 15PSI while keeping Nox low , but a closed wastegate will always be better than a modulated one in outright power.
Anyway I am happy at present.

What exactly are you not agreeing with Phillip? The modulator itself, or the fact that you'd modified the system, thus making the modulator redundant. It ain't Gunna work if you've tweaked the Christ out of everything is it??? It's made (the modulator) within certain parameters, anything outside that is obviously going to render it useless.....
