    Pre settlement inspection

    Hi

    We have just completed a pre settlement inspection on our house purchase.

    Unfortunately (or unbelievably), when we had a look around, the carpet (in the study) had had a home made repair carried out. Basically a corner of the carpet about the size of a tabloid newspaper had been cut away and a newer piece laid in. Pretty amateurish job. When we continued the inspection we found where the newer piece had come from. A piece had been cut out of one of the bedroom built in robes!

    Estate agent was sheepish and we are angry.....but unsure where we stand.

    Settlement is tomorrow and our conveyancer has advised they will get in touch tomorrow morning, (as it was too late for them to act on this).....but until then, does anyone have any advice?

    (We never noticed this when inspecting the property prior to purchase as the furniture 'hid' the sloppy repair.

    Also, some of the lecky appliances are no longer working (1 ceiling fan and one split air con).

    Where do we stand?

    If it was a rental at some stage it was probably done by a tenant to cover up something especially if they had kids...

    thanks for reply.

    it's not a rental. unfortunately the carpet that has been 'coiffed' is a good quality cream one. the replacement piece, taken (bodge cut) from the bedroom wardrobe has not even been cut perfectly or laid in properly, it sticks up, not even glued down or anything! you just cannot miss it when you walk into the room!

    Your conveyancer is the best person to talk too. But basically, if you're unhappy, then don't sign anything. If it were me, I'd probably enforce the agent to have the vendors repair the carpet in both the room in which the repair job was carried out, and in the robe where the piece was taken. I say this based on you not knowing of the details of the carpet prior to today.

    I'd also have the air-con, and the fan fixed before signing anything too. If I'm correct in thinking, all appliances should be functioning correctly when you purchase, unless of course, you were advised of their inoperable status prior to acceptance of your offer.

    Once again, your conveyancer is the best one to advise you of your rights. Call them first thing to discuss your options.

    Not uncommon to delay settlement.

    Helps if you're not in a hurry and the other party is.

    Talk to your conveyancer and see if you can delay settlement, but I believe you are obliged buy law to settle on the day unless the vendor agrees to a change.
    AFAIK you might be required to pay any of the vendors additional costs if you delay settlement.
    Having said that, you should be able to withhold an amount to allow for repair works, especially to non working electrical appliances that were previously working.
    As far as the carpet, I think you might have to wear it as it was up to you to thoughly inspect the property prior to signing a contract.

    Hi there.

    Hope all has gone well for you. If the settlement has taken place, and the carpet has not been fixed, it should not be too expensive to have a professional repair the "patch". Even if they have to cut an other from the closet to do so properly. Either way, if you like the house, and if it is what you want, settle and enjoy it.
    I know how stressful all this can be, as our purchase of our house in Clifton Beach becomes unconditional today. We had a pre purchase and termite inspection done, and they uncovered some termites under the house, in a retaining wall, and in the granny flat. Also had a leaking sewer pipe under the house. Our solicitor presented the vendors with an eradicate, and fix, or no deal. They have agreed, so we move north from Melbourne in October.
