I'd fight it as hard and as far as possible. Worth going direct to LR Customer Services if you get no joy from the dealer.
Hi there, new to this forum. Sorry if this is not posted in correct place.
Some advice or opinion wanted.....
I bought a new RRS in April 2009, with 3 year land rover warranty/ servicing, so is obviously 4+ years old now. Done 35000 Kim's.
Just before the warranty expired, we took the vehicle back to the dealers service dept, because we could hear an intermittent rattling sound from the engine. When they examined the car, they could not find any problems, and was making no abnormal sound.
Since then it has made this sound on the odd occasion. Perhaps once or twice per month that we could hear.
Yesterday it was suddenly very loud and the whole engine was vibrating quite severely, then engine cut out. Had it towed to Land Rover by RAA.
Spoke to service dept today. They say any repairs are not covered under warrantly. Because they could not fault the car under the warranty period, it is bad luck basically.
I am convinced this problem has been there (in a mild form) all along. I have recorded the abnormal sound on my phone, and actually played this to them when they looked at it last year. I still have this recording.
Any comments?Bend over and take it, or fight it??

Your rights are not diminished by their incompetence...
The relationship between dealers and manufacturers is a bit like that between doctors and MedicareThere's a scheduled fee for everything and the rate at which dealers are reimbursed for a set job by the OEM is less than what they'll charge you when it's not under warranty. OR if they do the right thing and fix it under warranty then they have to negotiate with the OEM to get reimbursed...
did they give you any clue as to what's broken?
You brought the issue to their attention well within the warranty period and you were dismissed... not good enough! That doesn't absolve them of legal responsibility.
I totally agree with Sheerluck... make a reasoned approach to LRA and politely "demand" they get it fixed under warranty..
Prior to this I suggest you check with "Consumer Affairs"/ State Dept of Fair Trade or whatever reincarnation they are operating under at present and get an opinion as well as a recommended course of action... take that with you when you make your case to LRA..
Good luck with it... it's emotionally draining ...but your case seems solid!
cheers

Thanks for the above replies.
Also forgot to mention my relative is a very good mechanic and he listened to my sound clip.
He thinks it sounds like the hydraulic lifters are faulty. I found this on YouTube and it sounds like the same noise.
I would suggest you contact the Legal Department of the RAA, and get their advice.
I have spoken with them in the past, and IIRC, the dealer is an approved RAA workshop, so they also have a vested interest.
Polite, but firm, has always been my policy...![]()
Hoges:Your rights are not diminished by their incompetence...
Good quote, I reckon "Your Rights" are actually Enhanced by their incompetence,
Stick it to them Jondg1, good luck, Regards Frank.
Update.
The mechanics have had a look. Apparently it will need a new engine. Thats disappointing for a 4 year old RRS with only 32000 km!
They have written to LR Australia to see if they will cover it.
We shall see....
Australian Consumer Law - http://www.consumer.tas.gov.au/austr...ess_guarantees
A vehicle of that price, that age, and that few km can be reasonably expected to have an engine last longer than that. The 3 year warranty is irrelevant.
Fight them.
Petrol or diesel???
Hasnt been miss fueled by any chance????
Caltex to a Vortex PULP fuel,I use it in my boat, however they also sell a premium Diesel, also branded Vortex, the pumps look very similar.
Others have been caught out.Fortunately a TD5 Defender will run without damage on a 50/50 blend,as proved by SHMBO.The newer motors wont.
If its not miss-fueling,fight them, even if you have to agree to pay the labour/they supply the motor.Nissan were doing this to select customers with faulty 3.0lt diesel motors that handgrenaded out of warranty.
