Fight it, Australian consumer law means you can get pretty much anything you want from them. Considering the age of the vehicle you should have no issues getting it repaired by the dealer. Just remind them of consumer law and they usually cave.
There were similar provisions under the Trade Practices Act - Statutory Warranty. The new rules clarify the warranty aspects and supposedly make things easier to claim under.

Good luck going to LRA Customer "Care". They are the reason I will probably never buy a new Land Rover product ever again. Bunch of total arseholes who will use the technical wording of the warranty terms & conditions to weasel out of any claim, then wear you down whilst you quote Trade Practices Act or Australian Consumer Law at them until you just give up and go away. They know full well that in most cases it is not worth the customer's time and money to fight for a win in court.
Update:
Goodwill claim sent to LR by the dealer. Rejected due to not knowing cause of engine failure. LR asked dealer to remove engine and investigate. Broken connecting rod found. Unclear why.
Goodwill claim re submitted. Last info I heard was 6 days ago. No communication since then. Info from dealer has been poor, I have to keep following up with them to find out what is going on.
They have had the car for 4.5 weeks. Incredibly slow progress. Looks to me like I will have a fight on my hands soon....
All fixed free of charge by LR. The goodwill claim made by the dealer was eventually successful.
So now I have a new engine in my car. Happy days.
No indication what went wrong with the original engine. A con rod had broken, but not sure why. Apparently the engine will be shipped back to Solihull for analysis.
Anyhow perhaps it's time to upgrade to the new model. Anyone want to buy a 2009 RRS with a new motor?![]()
It's good that things seem to have been sorted out to your satisfaction.
However, I'm curious the know what the original noise was. I find it hard to believe that something as catastrophic as a broken conrod would make a bit of a noise "once or twice a month".
Was there some other problem either before or in conjunction with the broken conrod?

Good News!
We had a school bus with a 330 Bedford diesel in it, and every so often going round a bend near the depot we could hear a knocking sound,was like that for 2 years,when we removed the motor for overhaul/rebuild we stripped it and on removing the crankshaft and it was broken under the centre main bearingthat was the knocking sound we had listened to for 2+ years.
