    Out of Control Parties.

    First up - I'm being political so will be reporting myself, but hey this proposed new "Out of Control Party" law in Queensland is over the top!

    Queensland party crackdown out of control - The Drum (Australian Broadcasting Corporation)

    I just love one of the comments where they want to report the LNP for being an out of control party.

    Queensland, perfect one day Police the next!

    I am confused (please explain) it is in Australia separation of power between governments (sate of federal) and the Justice system?
    Can a government interfere with the Court of Law?
    If it does, what will be the implications? Who will stop that?

    i distinctly remember the last episode ended up with a "no party politics or religion of any type" rule evolving.

    i personally consider general political overview is tolerable but as soon as it gets heated, divisive or party biased its a no no and should be removed,

    those involved in taking it to the next level or getting personal either get warnings or points if it is not their 1st offence..

    if there is any sort of blow up over that sort of discussion then anything political should be barred i suppose as it is just too divisive.

    The parliament sets the law the courts interpret them and admister the penalties as set by the laws.

    There is however a heirachy of laws, i.e. all laws have to be compatible with each other, with the Constitution of Australia being the highest law in the country.

    If legislation contravenes a higher law, it will be the courts that strike down the law for the parliament to either revise or repeal.

    The Governor of the state or Governor General of the Commonwealth can dismiss the Government under certain circumstances. In fact under Commonwealth law (Constitution) this power to dismiss a Government exists with the Governor General not with the Queen even though Her Majesty is the Head of State.

    My question was in reference to what happens few weeks ago in Qld when the premier made comments about how the court acted or should act in the case of the bikers.
    I am under the impression that could interfere with the Court proceedings and will be a breach of the separation of powers if that exist in the Australia Constitution.
    Then again, I can be wrong.

    We had a taste of that a couple of weeks ago when the DPP was appealing about the bail for a bikie and the judge suspended the case because of comments Campbell Newman had made about the court.

    We can expect more of if if the Government starts interfering with the administration and independance of the court

    what persentage of the population actually end up infront of a judge........

    This is nothing new in Qld,we had this I the Joh era,those that are old enough or have memories going back that far will remember that a lot of power was held by the
    Premier and a few ministers in that era,particularly one Mr Hinz "Minister for Everything",Main Roads,Racing,Vice(the running of) and any questions from the public/media was fobbed off with "Now Don't You Worry About That"

    Aha! Just feels like old times,give a party a big majority and it happens,both State and. Federal.

    Mostly it will be dealt with by magistrates or Justice of the Peace, (will rarely be heard before a Judge) however the definition of out of control party being 12 people where swearing, loud music etc is present and that the host will be charged an issue, when it may be gate crashers causing the disturbance.

    Everything in the law can already be prosecuted by other legislation so its redundant as new legislation other than to oppress young people.

    Like it or Not

    Hello All,

    Like it or not whomever we have in each tier of government are examples of our own democratic style of government in action.

    At least we have the ability to rectify the situation in three years time if we do not like the way the current elected governments are running.

    There are other parts of the world where people do not have the same luxury.

    The current incumbents only got put into power because the majority of people voted for them. That is called a "democracy"
