Accident Letter of Demand

Doing a tight left turn today and a 12 tonne rental truck coming towards me and turning right cut the corner and clipped the back of my RRS doing a bit of damage.

What Hit Me

How far he was across my side - see the double unbroken lines under the truck. The impact was about 2m further back so well on my side of the road.

So with this amount of damage, though it will be more expensive than it looks I really do not want to claim on my insurance.

So as it is a Hire Truck should my letter of demand go to the driver of the truck who hired it or to the hire company??

Rental trucks carry huge excess, so depending upon the quote he'd may well want to pay cash. However I don't know that I'd want to take the risk of the driver skipping on the repair.

Have you reported it to the Police assistance line? That would be my first step so there is a record.

Whenever I have hired a vehicle I have had to pay an insurance payment, it is the Hire Company's insurance, I believe you would have their insurance cover the damage and they would take the excess from or charge it to the hirer.

Good luck, persist if you have to.

As the others have said Garry, I'd be writing letters to both and using registered mail - with a signature for delivery of both.

Should be addressed to the owner of the vehicle - i.e. the rental company. A copy to the driver would be a courtesy, as the owner is liable not the driver. Under the hire agreement, the driver will be responsible for the excess, or he may have paid extra to waive the excess.

Follow the suggestion to report it to the police advice line, that way there is a record of the event in case the hire company's insurer wants to be difficult.

Thanks for all those great comments - yes i have filled out the online accident form that is required in the ACT.

I did ring the hire company before closing and there was no negative response from them - quite reasonable actually. I am actually glad I did as I bet that with no real damage to the truck the renter would not report the incident to the hire company.

I will go around and discuss it with them on Monday and if the result is not satisfactory then the letters as advised.

Regarding the Registered Mail, I would not trust the Post Office to deliver to the driver. Pay the extra few dollars and have the letter delivered by a courier company who are guaranteed to actually deliver it to the correct person and obtain their signature after seeing photo ID.

I think you should register it with the police.
Not to be vindictive but because if the damage exceeds $2000 (I think) it needs to be registered with the police.
That way, if who evers insurance gets difficult, you have also done.

With the cost of some car parts (light clusters etc) and the re-painting, it could easily get close to that value.
