Jail (or gaol) is a punishment, but it does not of itself rehabilitate. People only rehabilitate if they want to rehabilitate. If they don't want to change, then it doesn't make any difference if they are locked up or not.
I know a magistrate who tries to persuade people to take the chances he offers them to rehabilitate. Some do, some don't. Those that don't end up in jail. Many of them, upon release, reoffend and end up back before the magistrates. So the cycle continues.
Instead of blaming the courts, let's blame human nature. We are all victims to some extent, but that doesn't excuse us from having to take responsibility for our own actions. Some people appear to be successful in life, but actually they're worthless people whose attitudes and behaviour are contrary to everything most of us would regard as good.
To put it another way, and to be sexist, some of us blokes never learnt how to 'act like men' and it shows in our lives. I get it wrong too, but at least I'm trying to be better.
