    Our "Justice" System?

    Two cases recently make me wonder where we're going?
    Case 1. A person with a MASSIVE number of priors has an incident with a Police Officer, where this "person" grabs the officers gun, and shoots the officer in the leg, with the result that the officer is now in a wheelchair, & probably won't be able to work again. Penalty"?.....a CBO!!
    Case 2. Unlicensed driver with 200+ priors of varying descriptions rear ends a car with such force that the occupant of the hit car is almost cut in two, and is killed. Penalty?.....18ms jail (with what "minimum"term?)'
    I do not understand these "sentances"?

    First off we have a legal system not a justice system....

    It appears that there a terrible lot of inequality in the way it is exercised but it appears to have always been that way when you look at it...

    Yep, what Dave says, we have a "legal system". No justice involved.

    And our jails are full. We can't built them fast enough.
    Add to that, in most cases, rehabilitation achieves better results outside the incarceration system as opposed to in.

    So, a question, would a justice system be about revenge/punishment or rehabilitation?

    Community Based Order whereby the offender, instead of going to jail has to give x amount of hours doing work for the community, it might be 200 hours etc. and that work could be anything, it might be just picking up rubbish from the side of the road.

    A few victims of constant repeat offenders would highly disagree with that.
    Too many re offend and re offend. The system of rehab failed.

    But Micks point is still valid - where do you put them with Prisons bursting at the seams already? Australia has the fastest growing prison population in the world at the moment - more people are being locked up now than ever - which is unsustainable and they know it - even with all the new prisons being built now, they won't keep up.

    I was listening to a story this morning. A 13yo was up before the courts. He had around 200 priors for theft. The judge asked him what his dream was. "To have a bike." he said.
    The judge ruled if that child did not re-offend for three months, the judge would buy him a bike. The boy got his bike.
    Better, and cheaper, than sending him to jail.

    And the kid who has never stolen but wants a bike too? How does he go about getting one, start stealing?

    Touching story but I don't think that's the answer.
