Why was the man clinging to the car not charged?

If i was to drive my car and hold my arm out the window i can be charged.
If i do anything that can be seen to potentially cause harm to others then i can be charged.

If your swinging off the front of a car then your potentially endangering others.

Details had been exchanged so there was no need for this.

The driver could actually claim self defense. although not sure how well that would work.
