Thread: Advice needed - they want to write off my Defender

    That's a point I have a little on being a smarty pants sorry. The Bike crash plus 12 months ago was on a 20 year old machine which I did not insure. The guy at faults insurance was at first impossible then very very good once I got to speak with the right person (Shannons I like them). The paid the book value of the bike and picked what was left of it up. (Not much)
    If the people that did the damages has insurance you may find it better to take it to them. If they don't try discussing the fix up cost with the uninsured person perhaps. Your insurance company will peruse them for more I assume if they have no insurance. It may be cheaper for them to help you and that could be a win for you.

    Insurance companies do not fight each other.

    If the prime contractor is legit, there is the possibility that they have the same insurers as you.
    If the two actual brush jugglers are employed by the painting company, the painting company is responsible for their actions.
    If you don't like trucks, stop buying stuff.

    Ah, of course. That hadn't occurred to me. Good point. I'll keep that in mind. And re the company being responsible, the boss has already said as much. And I've got copies of texts from him along those lines. That part is all very clear.

    If my neighbor had a tree lopper come in and cut a tree and it fell on my house , I would be chasing the tree loppers insurance company.(thankfully my neighbors are far awayAdvice needed - they want to write off my Defender)

    I pay insurance premiums so that I don't (or shouldn't) need to do all that legwork myself. Yes, it would be the lopper who you'd chase (not their insurance company - isn't that up to him?), but why would you be so keen to do it yourself when that's precisely what you pay your insurer to do?

    Insurance companies fight each other all the time. Even down to running trials over a few hundred dollars.

    Yes and another example of insurance companies dealing with each other...I had a neighbouring gum tree in a council reserve, of which it's roots were starting to lift my concrete driveway. The council came and put in root blocker and advised me that if I considered that there was damage, to notify my insurance company, and they would deal with the council.

    Had that same tree dropped a limb onto my carport(which I would have been happy about, re my rusty roof!), I would have contacted my insurance company and said I need a new carport please....and here is the details of the other party.

    Just like when you have a crash(other driver at fault)....you don't run around trying to get the other drivers insurance company to pay you, unless you don't have insurance yourself. You report it to your insurance company, and they do what you have been paying them for years, to do.

    Yes - just like the last time a bloke ran into the back of me - I spent months arguing with the insurer who wanted to write off my car. Unfortunately the bloke who ran into me had the same insurer. And, I even had to find parts for the repairer. But they repaired it eventually.

    Exactly mate. I would rather argue with my insurance company, and if not happy with them, contact someone like Australia Financial Complaints Authority..... Info about before making a complaint.......than take another party to court. Anyone hired a solicitor lately...a few years back I went to a solicitor to see whether I could fight a case(not criminal)....to sit with him for 20mins and have a letter sent to me outlining things $700. I gave up on that said case, as my legal fees quote from him was $20k.(to fight over $7k).
