Thread: Sold fridge on eBay & it's failed on the customer

    I think it's just bad luck for the purchaser. If it worked when he collected it, and he left positive feedback .... well it was all good when he bought it obviously.

    I have learnt the hard way about giving eBay refunds. Two sales - a PC mobo and a mobile phone - I had the buyers contact me 1wk after to say they were faulty.

    I refunded their money. Imagine my surprise when both de-listed from eBay on receipt of their refunds. The mobo had been cracked by the use of too much force (buyers fault) and the mobile had been attempted to be modified (what for I don't know) and broken.

    So now I always state in my auctions "there is no warranty, what you see if what you get, if you are worried collect it and I will demonstrate it working".

    If the fridge is not that old and Waeco have a 5 yr warranty, why can't he just get it fixed under warranty? Does the warranty only apply to the original purchaser?

    Maybe you can put it into Waeco under your name, get it fixed and then give it back to him?

    I have known of this problem with a workmates waeco he bought it brand new and when the compressor went down the track (within warrantee) the company replaced the entire unit. This happened twice to him. This is the advantage of buying new.

    He may be a nice guy, to you, we know you and know that you are a nice guy. Ebay is trouble in this sense. Ask yourself if you think you should be out of pocket?
    Who can tell if he isn't just trying to scam a second fridge out of you or he hasn't swapped the fridge for a broken one and get you to pay? It has been nearly 3 months since purchase.

    If you want to donate $900.00 to a just cause there are many tax deductable charities available.

    OR

    Give it to someone who needs it

    He bought the fridge "Buyer beware" with all, if any faults. If he gets it fixed he will enjoy the nice cold beers, not you.

    It's tough but only fair, If you sold him your Fender and the engine blew after 3 months would you pay for the rebuild?
    If you answer the last question with a yes, Could I buy your Fender?

    As previously stated, he didn't make any noises about the fridge when he received it, so it was obviously working. Now 8 weeks later it has stopped, bad luck, I certainly wouldn't be offering a cent!

    tuff i say.
    unlucky, but i've seen 4 waeco's come in from the one group after crossing the simpson with the same major fault in every one.
    they look nice and work ok but don't like the rough treatment.
    give me an engel any day.

    Omaroo: DON'T ENGAGE IN ANY FURTHER INQUIRIES ABOUT THE FRIDGE. You can actually be sued and emails and conversations about the matter can go to court and the level of proof is On the balance of probabilties - not beyond reasonable doubt. I know this may be a little tough, but the bottom line is this: Ebay's complaint resolution process (which is a good thing) has a time limit of 30 days from receipt of goods. If the buyer hasn't filed a complaint within that time, (AFAIK) then from then on he cannot complain that the item was "Not as described". And therefore not sue you.
    I know from experience that we all try to act in an equitable manner - but in this case standing firm (politely of course) is self preservation.

    I agree with everyone else chris, you sold the fridge as a working fridge, he was obviously happy with it as he didnt email you straight away to complain about it. You arent telepathic you cant predic the future you werent in anyway dishonest, next time he might learn and buy a new one. Matt

    Do you think this thread should be deleted? Omaroo has his answer so continuing discussion may not be fruitful. (I'm not stirring, just trying to help).

    BTW, I liked the use of "inquiries" rather than "enquiries" - very apt.
