    Check the council regulations for fencing and their requirements for submission of plans and subsequent approvals. That way you can establish if the structure is legal. Legal representation may be required. I would have thought that any footing is shared equally between the two properties. Sounds like the neighbour is trying to bluff his way through. Another thought as well, is to have the boundary surveyed as it wouldn't be the first to be incorrect.These can turn a bit ugly as some councils don't want to get involved, but if there a clear defined rules and regs. for boundary fences then the council is duty bound to enforce their own policies.
    I know if it was me, I wouldn't take it lying down!

    Did they have a permit and need one?

    I know in Vic if they build something without a permit we can apply to VCAT to have it pulled down... at their expense not yours.

    They also may have needed council permission. The council can also order a rewind, again at their cost not yours. (we did this to our neighbours that built an illegal car port - they were not happy, but we wern't living with a car port blocking natural light into our house)

    Did they take down any natural (gum) trees... also potentially illegal. Need a permit in VIC to take down trees (in most instances).

    Ok Vlad you never heard this from me...............
    Take one cane toad, obtain a large nut and some fishing line. Attach nut to toads rear leg with fishing line and place gently on neighbours roof.
    Toad will jump around causing a hellish noise once every few hours. Hard to find the cause of the noise and toad usualy just jumps off roof after a few hours.
    Suggested in the cause for better education of things that would be immoral to do

    If the wind normally blows towards the neighbours then put anything that is really smelly up against the retaining wall. Otherwise try to make the view from their place as bad as possible.

    When the council in ashburton built a new foot path out the front of a mates rental and then kids used to go along banging on his fence every day he got some scunk that they put in LPG and Natural gas to give it it's smel and put a few drops out there on different parts of the path until the gas company came and ripped it up.
    Problem solved path never went back.

    what fence ? Just a retaining wall and neighbours are above, looking down. No fence on top of retaining wall coz neighbours reneged on verbal commitment to build one.
