No matter what anyone says, if a road is gazetted and on said maps you have the right to use it unless it has been closed by a duely appointed government body and is signposted as such. A private property sign gate or whatever else does not constitute this and is infact an illegal addition to any such road. Some land owners are given permission to put in gates etc but they are not supposed to be locked.
Try going through the process of getting a road de-gazetted. We did in Kambalda, what a drama that is.

It has been 5 years of pain!!

I am going through the road reserve not being wholly on the road reserve thing now.. Should I say it has taken 5 years so far. I am at a stale mate between lands department and local council.

The fanny thing is that you can drive across the land as it is now and the lands department has deemed it major works so they don’t have to do any thing with it… They say the council has to take it over as they are not road builders.

I would love to know my rights as all I want to do is drive across it how it is now!!
It is now deemed as land/road reserve

    Can anyone offer some help?
