    Drink driving



    Only an Aussie could pull this one off!

    A true story from the Mount Isa in Queensland.
    Recently a routine Police patrol car parked outside a local neighbourhood pub.
    Late in the evening the officer noticed a man leaving the bar so intoxicated that he could barely walk.

    The man stumbled around the car park for a few minutes, with the officer quietly observing. After what seemed an eternity and trying his keys on five vehicles. The man managed to find his car, which he fell into.
    He was there for a few minutes as a number of other patrons left the bar and drove off. Finally he started the car, switched the wipers on and off (it was a fine dry night). Then flicked the indicators on, then off, tooted the horn and then switched on the lights.

    He moved the vehicle forward a few cm, reversed a little and then remained stationary for a few more minutes as some more vehicles left. At last he pulled out of the car park and started to drive slowly down the road.
    The Police officer, having patiently waited all this time, now started up the patrol car, put on the flashing lights, promptly pulled the man over and carried out a random breathalyser test.

    To his amazement the breathalyser indicated no evidence of the man's intoxication.

    The Police officer said "I'll have to ask you to accompany me to the Police station - this breathalyser equipment must be broken."

    "I doubt it," said the man, "tonight I'm the designated decoy".

    Urban Myth I am afraid.
    Has been cited in every town in Australia for the last 20 years.
    Police do not have to wait for you to drive a car to book you for DUI or DD. You only have to have the keys in your pocket and I have seen this doccumented and proven in court transcripts.

    True story, a copper I know told me that one night at Camp Hill, they watched a bloke stagger to a Toyota ute in the front car park, go through the drive-in and then off down Old Cleveland Road. They stopped him and found he was drinking a stubby from the six pack he bought at the drive-in and had lit a cigarette as well. On asking him to get out of the car he replied that he couldn't, he was too pi**ed. He went 0.286 on the machine at the station, fifth offence but not in two years so didn't get a gaol sentence.

    what's DUI ? I take it it's driving under influence ?

    so if you have keys in your pocket and stumble out of the PUB , walking towards you vehicle , you can get booked even it you're not driving it? how's that driving under influence ?

    I guess that if you had a few and decided to sleep it off in the back seat then you would get busted if you had the keys in your pocket?

    That is so, and it has happened to plenty. You are drunk in charge of the vehicle.

    Don't you have to have your key in the ignition to be in charge of a vehicle?

    These days it's an actual offence of drive, or attempt to drive. So the proofs of attempt drive must include, attempting to put the vehicle into motion - engine on, in gear (or attempt to engage drive) plus any other observations. Having a camp in the seat with the engine running won't cut 'attempting' to drive - which is a good thing (might be cold, might be listening to some music to drift off to). There's been plenty get away in the past but plenty of stitch ups to, and that's crook..

    That's in NSW anyway...
