The photographer is well within his rights to assert his copyright. No watermark is required to claim copyright, it's automatically yours whether you write "copyright XXX" or not. This is true in Australia, the UK and the USA at least.
However, most pros would never put any image they cared about on the web without a watermark, for exactly this sort of reason.
As for the response...you can almost see the froth on the screen. What an idiot.

Technically no watermark is required anywhere in the west, if a country is a signatory to the Berne Convention on Copyright (various years), a photographer is automatically covered in said country. End of story, or is it?
Some South American countries do require images to display a copyright notice along with a caveat that all rights are reserved. This also can carry extra emphasis in the 3rd world as it's an expression that without explicit permission an image may not be used. Most professionals use the format:
©Year~Years Name of Photographer - All Rights Reserved.
Electronic watermarking using embedded serial numbers, user idents etc is frankly a waste of time. I've yet to see a system that can't be altered or removed. The only method that works in most cases is to render the image next to useless, even for viewing by the use of a large visual watermark (see example).
Most professional photographers don't even have a website, we're all too busy working!
