    Rego without a RWC?

    Hi folks,
    About to buy a Disco 1 from a dealer in Melbourne, advertised with Rego until March 2010, but not being sold with a RWC. Just wondered if anybody knows whether a dealer can legally sell a registered car without a Roadworthy?

    Not really by the Vicroads paperwork, BUT, the transfer CAN be made without a RWC into your name, its meant to be produced within 28days, then the onus is on you to provide it, my experiences atleast, having dealt with them on just the odd occasion

    Good luck with calling Vicroads, as they have no idea

    Dunno about Vic - but I thought that in most states a Licenced Dealer can sell a registered car without a roadworthy. I could be wrong though.

    In Qld. a car offered for sale registered must display a copy of the Safety Certificate. It is an offence to offer a registered vehicle for sale without one.

    Other than dealer to dealer, a vehicles registration will not be transferred without a Safety Certificate. A vehicle may be sold unregistered without a Safety Certificate but one will be required to register the vehicle.

    A licenced dealer may buy a vehicle without a Safety Certificate and sell it to another dealer without one, but if the vehicle is offered for retail sale it must display a copy of the certificate.

    Im not a 100% sure, but don't they have to supply one (RWC) if a cars over a certain price?

    As I understand it, this is basically the same as in NSW, and I would be very surprised if it is not pretty similar in Vic.

    they can also sell a car with a current roadworthy ticket and previous owners registration but then its your problem to re-register it. Its their problem if the registration expires before they sell it. Like say the previous owner actually hands in the sold vehicle paperwork to the RTA.

    There is a proviso for a brand new fresh off the boat vehicle to be registered with just the dealers workshop safety check documentation.

    As far as I know every vehicle must be sold with a RWC or the rego suspended and the plates returned.

    Of course in reality in private sales there are always vehicles sold without a RWC and as mentioned the onus is on you as the purchaser to provide one within 14 days as I remember from a recent transfer in Vic.

    Unless you know the seller well and are fully aware of the risks and potential expenditure to get it to RWC I would query why the dealer does not want to provide RWC. Ask him what the extra $ would be to get it to RWC or at the least offer to pay the $ 75 or go halves for a RWC test which will outline what is required.

    Pete is correct, legally he cant sell you the vehicle with the plates on it till it has a rwc - i would think that is was illegal for him to sell without a RWC if it still has rego . I would call victoads and check, if you can get thru and get someone who speaks english.

    I would think that a dealer offering a vehicle without a RWC would be worth his licence.

    Mind you, a news item today in Sydney featured a dealer who was selling prestige cars on consignment from private owners - one owner found the specified address to be unoccupied. Three men have been arrested, and 180 cars are missing; not all dealers are on the up and up!
