I have just had to rebuild the gearbox in a vehicle I own, bought new in 2003 and has just clocked over 70000kms.The failure was caused by delamination of a bearing which subsequently caused damage to the rest of the bearings in the G/box.Now the job has cost about $5000 and its paid for and I'm over it.BUT I have just come across the mechanics report from its 5000km warranty service, stating "odd sound from gearbox".I cant really stomach the BS carry on and raised blood pressure that goes with warranty claims, but would be interested in thoughts as to whether this one would be worth pursuing.All other services have been recorded and performed by a well known firm.

Always worth pursuing but a lot will depend on who owns the warranty and their attitude to claims and their reputation. They might make a 'goodwill' gesture to you. But there is a big difference between aftermarket warranties and car company warranties as well as the brand of car involved. And if it is a manufacturers warranty was the car serviced by one of their dealer workshops - this would probably make a difference too.
I'm guesssing from your post that it isn't a Landrover.
But I'm puzzled as to why didn't you pursue the gearbox noise when it was first reported?
Any way, all this is only opinion/supposition. Better to ask the waranty provider.

the make of vehicle is unimportant, i'm more interested in the fact that an issue was reported whilst the vehicle was in for scheduled servicing and not followed up (I never reported the noise and as the box worked fine there was no way they would investigate it further unless something stopped working anyway) , 70000kms later its stuffed. My take would be that the dealer conducting the first service reported this but did no further investigation, IF i used my vehicle as a daily driver this would have happened in the warranty period, because i didnt I pay.Fair enough, but as it was identified by them do I have any recourse? Obviously its out of warranty and has been for 3 years, time is not the issue, more kilometers travelled.Like I said, just after opinions from some that may have been in the same boat.

probably the question I'm asking is "Is the end of the warranty the end of any responsibility from the manufacturer regardless, final, over, thats it? There are no mitigating circumstances ever?"

I would suggest it is as different manufacturers have different attitudes to out of warranty claims. And no, I don't want to know what make the car is.
You can claim for anything you like when you like but you are at the mercy of the car manufacturer and their attitude to both claims and you. The other thing is that each claim is different to the next and there doesn't seem to be a golden rule.
As to responsibility - if they say no to what ever claim when ever it is made and you disagree for what ever circumstance the final arbiter is the courts and that is a lose situation due to costs.
Even seemingly legit claims within warranty periods can and have been refused by car manufacturers.
The only one who can give you a definitive answer to your question is the manufacturer.
I know at least 1 person who bought a 2nd hand vehicle (in this case a Land Rover), and when the gearbox needed a rebuild (out of warranty), wrote a letter to the head office. I believe they agree to pay half the costs (or parts but not labour).
However this may be because of the fact that mainshaft wear was something of a "known problem" with Land Rovers.
I know nothing about the legal side, but the fact that you have written evidence of a fault during the warranty period would surely help your case.
technically if youd caught it earlier and had oil sampling done you could have had a shot.
at this point they'll just claim wrong/low/no oil and not our fault.

From my experience,if it is a Japanese manufactured vehicle they will laugh at you,more than a few hours,or a couple of k's over warranty,they just don't wanna know....ask me how i know this
As for LR,have always found them good,but due to the age of the vehicle,you wouldnt think they would be real interested in the problem.
But then again if you dont try ,you will never know.
