If that is the little vacuum valve which lives under the air intake tubing then yes, we have replaced a couple of them. Symptoms consisted of a lack of power, albeit intermittently.
Anyone had any problems with this little sucker.

Mine died in the position that allowed excessive boost, whereupon the ecm cut the fuel every time the boost got too high. The motor rapidly changed between full power to nothing at around 2500rpm on wider throttle settings. It had to crawl up hills in a low gear on light throttle to make it home. I now carry a suitable length of hose to bypass the modulator and go directly between the turbo boost pickup and the wastegate actuator in case it happens again.

Big Jon, Do you work for Suttons? If so, one of my customers had one replaced there last year while on holidays. White '03 D2, heaps of racks etc , Bilsteins and 245/75 Cooper S/T's. He was very happy that it was fixed and couldn't believe there was actually one IN STOCK.

Andy was very impressed you guys had one! Saved him a bit of grief on his trip, thanks muchly for helping him out. Quite a few of us taswegians have been there for servicing as a halfway between the CSR and WA etc. They are all happy with the service etc so take a bow you lot. You keep fixing 'em and I'll keep sending'em.

I've had problems twice. Once was just a leaking hose and that caused the modulator to prevent the turbo from providing hardly any boost. That's when you realise just how torqueless a 2.5 litre non turbo-charged diesel really is. It would drive OK on the lightest throttle but would surge terribly on any other throttle setting. The dealer took ages to fault find the problem as nothing was showing on Testbook.
Second time the modulator electronics failed but because the symptoms were the same I knew what it the problem was. That wasn't much help as the dealer didn't have one in stock (it'll take a few days from E/S was the best he could offer). However I rang around some of the local LR specialists in WA and found one which I installed myself (2 minutes)
Small item but it can cause big problems.

This is exactly the issue that I am currently having!
I have just been playing around with what I think may be the actuator, it sits on top of the turbo, and from what I assume from looking at it, it must have an internal diaphram that moves the rod comming from it to move some lever on the exhaust side of the turbo. But I'll look at the modulator now...
Is there a way to test the modulator?
